Private Bailiff Scandal, 18 thousand files in the hands of three bailiffs whose

Fiks Fare denounced a scandal in the Private Enforcement system on Wednesday evening.

Three former bailiffs, Helidon Xhindi, Lefter Canaj and Fatos Alimadhi, whose licenses were revoked by the Ministry of Justice years ago, are holding tens of thousands of citizens' files "hostage" through bureaucratic actions. They are not handing over the seal, the files and the debtors' money, which they keep in their accounts.

But what are the state institutions doing? For more than two and a half years, all institutions have been aware, but surprisingly none of them have taken action. The police cannot physically find them, the State Bailiff cannot find their offices, while the Tirana Prosecutor's Office only drags out the investigations and has not requested any coercive measures.

A citizen complained to the editorial office of the show Fiks Fare, who said that her story began in 2013 and has not ended to this day. She secured an execution order for a debt she owed to another citizen. After many attempts, a court decision for an execution order was issued. For the execution of this decision, the citizen hired private bailiff Lefter Canaj.

"It was decided to collect the debt from my debtor. The money was transferred from the debtor's account, to the bailiff and then to me. The execution began in 2020, 2021 and 2022. Then they were interrupted. I learned that Lefteri's license had been revoked. I learned from the second-tier bank that the amount was withheld from my debtor's account and transferred to the bailiff's account. But, the bailiff does not transfer it to me. Even to this day, the debtor is withheld from the money," said the citizen.

"The accounts should be frozen. I don't know any more. The state should have these accounts frozen," says the citizen, who has no information about what has happened to the payments she should have received for many years. She says she did not go to the bailiff's office, but she called him, and he did not answer. "Then I called the competent institutions. If there were a result, I would not bother you! Result 0. I demand that justice be served. Why do things drag on? Why are they not resolved in a timely manner? But they drag on, drag on, until people get upset, angry, worried, tense, when something that needs to be done, is done in a timely manner," she says.

Fiks Fare has obtained a document, which the National Chamber of Private Bailiffs has sent to several institutions, including the Ministry of Justice, the Ministry of Interior, the Prime Minister's Office, the State Police, the Vlora and Tirana Courts, announcing that the licenses of three bailiffs Helidon Xhindi, Lefter Canaj and Fatos Alimadhi have been revoked. Xhindi in July 2022, Canaj and Alimadhi in May 2023.

"These three individuals continue to refuse to deposit with the Ministry of Justice the tools and documents they had as bailiffs. They do not hand over the seal, the means of identification, the archive and thousands of bailiff files. After the removal of the licenses, the whole situation has become a public problem. The former bailiffs are holding hostage the financial interests of numerous citizens, to whose detriment serious consequences have been caused. The inaction of the responsible structures of the Ministry of Justice, after so many months, has no justification. We note an extremely bureaucratic institutional stance of the Ministry of Justice," writes the National Chamber of Private Bailiffs.

This chamber has also received information from the banking system. "We remind you that, based on the data sent by the banking system, administered by the Ministry of Justice itself, it is evident that these three former bailiffs still have in their hands about 18,000 files - enforcement cases in the status of active cases. No measures have been taken by the Ministry of Justice, as it finds itself for the first time in its institutional history faced with this unprecedented situation, which is now turning from a problem into a public scandal," the document states.

The citizen herself says that she addressed the National Chamber of Private Bailiffs and they had a long correspondence. "The letter is from February 2024. It remained just a letter, as no development has occurred during the other 18 months. I have written to them these months, but they are sleeping. During this time, I addressed the Ministry of Justice. They have responded to me, but only state and are incapable of solving this problem. They do not give me concrete solutions," the citizen adds.

She has also addressed the Co-Government Office, which has only sent her a statement of fact, where she is addressing the Chamber of Private Bailiffs. "They give me very accurate information, but statement of fact. Nothing actionable! I have addressed the Prime Minister's Office. Something needs to happen. This is not just my problem," she says.

Further, the citizen expresses surprise at how it is possible that all the state institutions that deal with these problems have found out, and she is not the only one, but no one acts. "My debtor's money is being withheld. Does this state have the power to give me the money that is due to me? Do these people have no power? Wherever they are, they should be taken by the ear, sit at the table and have a commission decide to transfer the money to the creditors. These institutions need a little attention, there are dozens and dozens of employees who are paid for this work. What are these people doing? Why don't they help us? Is there a state?", - she concludes.

Fiks Fare has learned that the Ministry of Justice has sent a request to the State Bailiff's Office in Tirana to retrieve the files of three former private bailiffs.

Fiksi called Mr. Pjetër Caka, head of the Tirana Bailiff's Office, who said that a request had been received, but they had only received it from one of them, while the others had not been found and had refused to hand it over.

The journalists also called Ms. Klodjana Tabaj, who has been assigned to take the files from bailiff Lefter Canaj. The bailiff says that it is a big problem and dozens of citizens have taken them, but the state cannot find the bailiff and his office.

After these answers, the Fiks Fare group searched for the office of bailiff Lefter Canaj, which they found in the area of Shkollë e Kuqe. The office is locked, while there are files inside. Residents of the area also showed Fiksi Mr. Canaj's apartment, a few buildings away from the office. But, although voices are heard inside the house, Canaj and his family do not respond.

Fiks Fare addressed the Ministry of Justice, seeking a solution to the problem of thousands of citizens. Again, in response, the ministry only provides information, but takes no action.

For Mr. Helidon Xhindi, the ministry writes that his license was revoked in 2022, while the Tirana Court has decided to issue an execution order by the Tirana Bailiff. The execution has not yet been made possible even though the debtor has received a notification from the police. He has not appeared at the office. The bailiff has addressed the Tirana Prosecutor's Office with a report.

The ministry says that Mr. Lefter Canaj's license was revoked in May 2023. In December of that year, the Administrative Court decided to issue the execution order. "The debtor party becomes an obstacle, and has consumed the elements of the criminal offense of obstructing the execution of the executive title. The Tirana Bailiff's Office has filed a criminal complaint with the Tirana Prosecutor's Office," the ministry says.

Again bureaucracy and no action!

For the third bailiff, Fatos Alimadhi, the ministry says that his license was revoked in May 2023. Only in March 2025, the former bailiff submitted the unfinished files and archive files to the Bailiff's Office. In this response, the Ministry of Justice does not provide a solution to the problem that affects tens of thousands of citizens.

At the end, it is written that "the situation created will be finally resolved with the approval and implementation of the proposed amendments to amend Law No. 26/2019 'On the private judicial enforcement service' (Article 43)".

Citizens will wait for the law to be amended; it will be drafted, consulted with interest groups, passed through the government, parliamentary committees, and then approved by the Assembly. Again, it will take a very long time!
