The security measure has been postponed for the general secretary of the Ministry of Finance, Arlind Gjokutaj, a director of this institution and a bailiff, who are accused of abusing their duties and causing the state a damage of 1.2 million euros.

Arlind Gjokutaj did not appear at the hearing, as according to his lawyers, he developed cardiac problems in isolation, and was then transported to the hospital.

Only the Director of Personnel at the Ministry of Finance, Fatmir Hoxhaj and Alban Ruli, executor, were present at the session. According to the prosecution, these citizens acted by accepting the reward of citizen Ilir Thana, in the amount of about 82,000,000 ALL, of which 50,000,000 ALL transferred to the account of this citizen, treating him as the owner without being in this status, as well as executing for the second time a court decision executed by the Ministry of Finance in 2015.

The Prosecutor's Office at the Court of First Instance of Tirana has registered criminal proceedings no. 8586/2022 for the criminal offenses provided by articles 248 and 320 of the Penal Code.

From the acts of this proceeding, it resulted that:
Tirana Court of Appeal with its decision no. 16, dated 14.07.2000 has decided: "It is ordered to solve the consequences for finding the invalidity of the sales contract dated 23.04.1992 concluded between the sellers of the Directorate of Government Service and Privatization CA and the buyer I.Th, returning the parties to the situation previous, where the warehouse object no. 2 is returned to the Directorate of Government Service and the latter together with the PAK to return the buyer I.Th. the value of the purchased objects (warehouses and land), which is 103,046 ALL converted with the price increase index at the time of execution of the decision".

The Ministry of Finance and Economy has executed the decision no. 9150 dated 12.11.1996 of the Court of the Judicial District of Tirana, upheld by the Court of Appeal, paying off the full obligation to the creditor I.Th. the value of the purchased objects converted with the price increase index, based on the information sent by the Publications Sector to INSTAT.

Pursuant to the above decision, the Ministry of Finance has transferred to the accounts of the I.Th. value of 284,139 with spending order no. 90 dated 27.02.2015.

Further, it turns out that the citizen I. Th. has been directed to the enforcement office, which in flagrant violation of the law has assessed in 2022, the warehouse facility and the land for a total value of 145,867,920, removing and treating as the former owner the citizen I. Th. at a time that has never been with this status.
The entire value determined to be given to this citizen is determined in violation of the law and violates the state budget in about 1,200,000 euros.

Up to this stage, it appears that the Ministry of Finance has passed in favor of the citizen I. Th. the amount of ALL 48,118,366. Of this amount, it is proven that 25,000,000 ALL have passed in favor of the citizen Sh.P.

The proceeding body ascertains and appreciates that there are doubts that the actions of the executor, the Ministry of Finance and other persons have misused their duty by stealing from the State Budget up to this stage the amount of ALL 48,118,366 and attempting to steal the remaining part.

The prosecuting body has ordered the seizure of the amount passed to the citizen I. Th. and the target account of the executor, managing to seize up to this stage of the investigation about ALL 22,000,000.

The Prosecutor's Office at the Court of First Instance in Tirana has ordered the detention of citizen I.Th., for the criminal offenses provided by articles 134/3 and 320 of the Penal Code, as well as continuing the investigations regarding the criminal responsibility of the other persons involved. in this criminal activity.
