State for rent/Clientelistic contract? Institutions that spend millions of euros on rent: Why don't they invest in permanent assets?!

Over 300 million lek per year is paid for a series of facilities that serve as offices where various institutions in the country operate, according to the Ministry of Finance.

"We have analyzed in our office an analysis of public property that has been given through auctions and leases to the private sector in the last 10 years and it turns out that this has resulted in a very high number and a very large escalation of the land plots of properties that have been leased," said Arianita Brahaj, an economic expert.

"Even a number of institutions that have had the opportunity to invest in offices or work spaces have made questionable choices regarding land or location. This has happened in customs, it has happened in state-owned energy companies or other companies," said Zef Preçi, an economic expert.

"The municipality should decide to make public on its website the entire list of property assets according to the categories it possesses," said Agron Haxhimali-Institute for Municipalities of Albania.

The state has a long list of over 100 lease contracts. The National Food Authority operates in premises with a monthly rent of over 15 million lekë, a very high figure. The regional directorates of this institution in Tirana, Kukës, Lezhë and Berat are also located in private premises.

AKU: For the General Directorate, the premises have an area of ??1243 m2 with a net value of 1,267,860 lek per month, for the AKU Lezha Regional Directorate, the premises have an area of ??291 m2 with a net value of 160,000 lek per month, for the AKU Kukës Regional Directorate, the premises have an area of ??276 m2 with a net value of 180,000 lek per month and for the AKU Berat Regional Directorate, the premises have an area of ??339.7 m2 with a net value of 220,000 lek per month.

The Constitutional Court has rented premises from a private company, but it remains unclear what spaces, in what area, how much surface area and what they serve. According to spending data, the monthly payment is 26 thousand lek. Another amount comes from the data of the Ministry of Finance, which speaks of a payment of about 35 thousand lek.

The central office of INSTAT and its subordinate branches in Elbasan, Kukës, Lezha, Shkodra and Vlora continue to operate in rented premises. Monthly bills range from around 52 thousand to 341 thousand lekë.

If we analyze it for 12 months, the rent for the INSTAT branch in Vlora would cost approximately 4 million new lekë. For 10 years, the amount goes to 40 million lekë or 400 thousand euros. This would be enough for the state to provide its own building and amortize the financial burden. After 10 years, not only will the problem remain there, but the money will continue to be spent in vain.

Interestingly, the Public Procurement Commission itself, the central tender institution, turns out to have rented premises for which it pays a whopping 798 thousand new lek per month. In a year, the amount amounts to a whopping 9.5 million lek, or about 95 thousand euros.

"This should be seen as irresponsibility not only of the central government which plays with ports, airports, large areas of agricultural land, but also of the local government which, by exploiting the authority they have, uses these properties in exactly the same way, that is, for financial gain, political corruption in some way and for no reason," said Zef Preci, an economic expert.

Ironically, the list of institutions that have rented premises also includes those under the Ministry of Education. Despite the importance of these institutions and the need to invest in permanent premises, universities, education directorates, education offices and others still have rented premises.

Aleksandër Xhuvani University in Elbasan pays a full 2.5 million lekë for rent. “Ismail Qemali” University in Vlorë pays nearly 11 million lekë. The local Education Office in Kamëz pays for two rented facilities. Other offices in Divjakë, Selenica and Vora also pay. The Regional Education Directorate in Lezha pays for two facilities.

Scientific research in Albania is non-existent, but universities have spent money on renting facilities that serve precisely this purpose. 3 facilities have been rented with values ??of 177 thousand lekë, 86 thousand lekë and 231 thousand lekë respectively. So, nearly 5 thousand euros.

It is not known what these facilities are used for, however, the costs are still weighing on their budget. Lawyers have reservations about the way contracts are drafted. Almost all contracts are the same and this is proven every time there is a dispute and the parties end up in court.

"In general, the quality of contracts in our country is the poorest possible quality. Most notaries have very limited and very common skills for drafting contracts. Over 90% of contracts would be replaced with just one line, both parties agreeing to apply the legislation in force for this contract," said Jordan Daci, a lawyer.

"We have contracts that do not personalize the specific circumstances of the parties, the object, etc., etc. This contract would be the one that properly regulates the relationship... ", said the lawyer, Jordan Daci.
