Defendant has been taken into custody, former prosecutor: Balluku may face other charges from SPAK

Following the publication of the wiretaps and the launch of investigations by SPAK, one of the questions being asked is whether Deputy Prime Minister Belinda Balluku could end up in prison.

Former prosecutor Eugen Beci explained in 'Log' on News24 that such a scenario is not necessarily mandatory, as everything depends on the criminal offense for which she is accused and the level of her legal risk.

"Not necessarily. It does not fall under those criminal offenses that have a high penalty margin. The charge of violating equality in tenders, for example, implies that SPAK has linked the procedure of a tender with communications, or relationships that may have influenced the selection process," said Beci.

According to him, if the investigation is initiated for administrative violations or passive corruption, then the case will be treated differently.

"If it was made by a lawsuit or for corruption violations, the matter will be investigated. But the security measure is not automatic ," he asserted.

The former prosecutor stressed that the security measure for women is treated with more care if there are special humanitarian circumstances. "A lady with a newborn child, or with serious health problems, can benefit from a relaxation in the security measure. But for the rest there are no exceptions - the law is the same for everyone," he said.

Furthermore, Beci has made a strong statement regarding the investigations against Deputy Prime Minister Belinda Balluku, hinting that the current issue may not be the only one.

Beci said that the investigation into Balluk could be expanded to other areas related to the activities of the Ministry of Infrastructure, where, according to him, there may be other files under verification by SPAK.

"The fact that the Deputy Prime Minister of Albania has been taken under investigation makes me believe that SPAK will move forward with other evidence that could lead to new investigations into other cases that are currently in process, " the former prosecutor stated.

According to Beci, SPAK investigators are following an objective approach to determining security measures, but everything depends on the development of evidence.

"If it is proven that evidence could be compromised, then SPAK may have strong reasons to request more severe security measures, " he added.
