Shakira acquitted of tax evasion, Spain will have to pay her 60 million euros

Shakira has won the latest legal battle in a long-running case with Spain's tax authorities, who must now repay more than 60 million euros in fines and penalties unfairly imposed, according to a court ruling.

El Pais writes that the Administrative Chamber of the National Court of Spain has ruled in favor of the Colombian singer, canceling the case that had forced her to pay around 55 million euros in back taxes and fines. According to the decision, these amounts must be returned along with interest, which amounts to around 9 million euros. So around 64 million euros in total.

The court has found that Shakira should not have been considered a tax resident in Spain during 2011. This decision does not affect the criminal case for which she was previously convicted of tax evasion in 2012–2014, where she received a suspended sentence and a fine.

In a public statement, the artist described the decision as a victory and sharply criticized the Spanish tax authorities, saying that "there was never any fraud" and that it has not been proven otherwise.

She has also stated that she has been treated unfairly for years, citing public pressure and damage to her personal and family life.

According to Spanish tax authorities, Shakira should have been considered a resident in Spain since 2011, but the court has assessed that she did not have sufficient legal ties to the country at that time, as she had no formal family reunification and carried out most of her professional activity outside of Spain during her world tour.

The court ultimately ruled that the taxes and penalties imposed were illegal and ordered the return of the amounts paid, along with interest. However, the decision is not yet final, as the tax authorities can appeal to the Supreme Court.
