The Tirana court has reacted regarding the release of the serial killer Dan Hutra, who spent only 8 months in prison for "domestic violence", after he raped his co-habitant, Elena Hysa.
The court has defended judge Gerd Hoxha, where according to her he has applied the law, while also giving the reasons why he made the decision to release Dan Hutra.
Notification:
"Judge Gerd Hoxha has implemented the law! The punishment is the one requested by the prosecutor. The application of summary judgment was not contested by either the prosecutor or the parties. The release came only after he had served all the punishment requested by the prosecution.
We remind you that in the court's decision, dated February 8, 2023, Dan Hutra was sentenced to 1 year and 6 months in prison and would only serve 1 year due to the shortened trial. This low sentence in the argumentation of judge Gerd Hoxha is said to have been taken for several reasons. First, the offense was committed intentionally by the defendant, driven by jealousy, the defendant took active actions, threatening (not threatening) with words but without hitting the victim or causing her physical damage; the fact that the defendant accepted the charge and showed remorse; the fact that Huta and the victim were expecting a child, to whom the defendant has basic obligations for growth and education. Also according to the judge, the author has a mother aged 74, who suffers from several diseases and also,
Meanwhile, in the other decision signed by judge Hoxha, on February 16, the termination of the security measure and the release of Dan Hutra are signed. This is because on February 16, it was 8 months since the arrest and since detention is calculated as 1.5 days, then 8 months of detention were equivalent to 12 months of serving a sentence. But before the decision to cancel the security measure for Dan Hutra was made public, the Court of Appeal of the General Jurisdiction published in detail how it rejected Hutra's lawyer's request to change the security measure from "arrest in prison" to compulsory for presentation".
