Sonila Muhametaj , who is running for the second time to become part of SPAK, sues the Court of Administrative Appeals , the High Council of Prosecution , and requests the illegal announcement of the decision of this institution, which is related to the criteria and the procedure for promotion of prosecutors.

Muhametaj, who is one of the 8 candidates competing for 3 vacancies in the Special Prosecutor's Office, asks the court to suspend the process of appointment and promotion to SPAK, until her lawsuit is examined. She currently works at the Prosecutor's Office of Tirana, while earlier she was a prosecutor at the Prosecutor's Office for Serious Crimes.

In the lawsuit filed at the Administrative Court, she claims that the regulation approved by the council in which the criteria for evaluating and scoring the candidates and then approving the list and finally appointing them to the SPAK, is in conflict with the law.

Prosecutor Domi objects to the part of the regulation, which states that candidates must have specific experience, which, according to her, is in conflict with the law.

He further emphasizes that the Council changed the regulation only 10 days before opening the competition for SPAK. In this regulation, specific criteria are provided, which is implied to favor certain candidates.

Another point that Muhametaj opposes is that the regulation stipulates "the obligation to submit to the "security conditions", i.e. a second VETINGU", which according to her is not provided for in the law at all.

"The law requires that the candidate has passed the vetting with a final and unappealable decision", Muhametaj emphasizes in the indictment.

The prosecutor also opposes the change by the KLP, of the evaluation scheme for the candidates, as well as the fact that the information classified as secret is not made available to the candidates, which, according to her, undermines the competition. In addition to Sonila Mumahetaj, there are seven other prosecutors competing for 3 vacant positions in SPAK.
