A new investigation raises serious doubts about the validity of the Belgian court's decision to award businessman Francesco Becchetti 100 million euros in an arbitration case against the Republic of Albania.

An investigative team of a foreign firm, hired by Albania, has produced evidence showing that Becchetti may have interfered in the arbitration process to secure a decision in his favor.

Evidence of Investigation:

The investigative firm conducted interviews with related persons and recorded them. Agents of the investigative firm interviewed several times Marco Giontella, a tax consultant and associate of Becchetti.

According to the Investigative Firm's report, based on these conversations, "Beccheti orchestrates premeditated fraudulent schemes to win arbitrations."

The report goes on to allege that Beccheti manipulates results by creating connections and corrupt practices that enable him to seek favorable results, citing evidence presented during conversations with Giontella.

Referring to interviews, the report says that Deutsche Bank was also a victim in a similar arbitration case with Becchet. As part of the Kalivaçi Hydropower Project, Becchet had signed cooperation agreements with several entities, including Albanian state bodies and Deutsche Bank. AG. However, the project failed and in 2010 Beccheti and Deutsche Bank initiated arbitration proceedings, accusing each other of breaching the cooperation agreements.

"As in the Deutsche Bank case, Mr. Beccheti used a similar method to control the appointment of the arbitration president, with the full assistance and cooperation of Mr. Giontella," the report says.

Referring to the testimony of interviewees, the report states that Beccheti seeks to "influence the appointment of judges in his cases and their decisions through bribery."

In particular, investigators claim to have evidence that Beccheti secured the agreement of the appointed judge to rule in his favor during the proceedings, according to a report by EuroReporter.

In another arbitration case, Becchetti is alleged to have influenced the appointment of the tribunal's president, and Becchetti's lawyer in the ICSID case had a personal friendship with the president of the arbitral panel, which has compromised the integrity of the arbitration proceedings, according to the report.

The report also included a statement from the expert witness, an Italian university lecturer, Alberto Pasquale, in the ICSID case, who admitted that he had lied to the arbitral tribunal and that no real harm had been caused to Becchetti. "Mr. Pasquale admitted breaching his duties as an impartial witness by interacting closely with Mr Becchetti, whom he referred to as 'the Boss' in the case against the other side.

In his erroneous assessment, Mr. Pasquale gave false indications and statements about the improvement and growth of Agon Channel, while he had a completely different personal opinion (that Agon Channel had no opportunity to grow)." says the report.

"Mr. Pasquale confirmed that his role was to serve the interests of the paying party (Mr Becchetti), rather than to serve as an independent and objective expert.”

The Investigation Firm's report and all the interview videos have been submitted to the Brussels court, in support of Tirana's requests to cancel the decision that awarded Becchet 100 million euros./ IntelliNews
