Arben Grori

The High Judicial Council has suspended for three months the judge of the Court of Elbasan, Taulant Taga. The latter is accused of reducing two years in prison to the convict Arben Grori.

In today's session of the Supreme Court of Justice, it was decided to partially accept the request of the ILD, which found a violation during the performance of the duty with the decision to reduce the sentence for the convict Arben Grori by two years. The HCJ has partially accepted the request by imposing a temporary measure of suspension.

KLJ's announcement

During today's hearing, the High Judicial Council has partially accepted the High Inspector of Justice's request for disciplinary proceedings against Judge TT of the Elbasan Judicial District Court for disciplinary violations committed, in the trial of the request for a reduced sentence, for a sentenced to life imprisonment.

The High Judicial Council set the measure of suspension from duty for 3 months with the right to benefit from the minimum salary for the magistrate. The High Inspector of Justice had requested proceedings with the measure "dismissal" against judge TT

From the legal analysis of the facts collected during the disciplinary investigation against Judge TT, the High Inspector of Justice concluded in the investigative report that actions/inactions committed by the magistrate were found in violation of the law "On the treatment of those sentenced to imprisonment and of detainees" amended, which have brought as a direct consequence the unfair benefit of reducing the sentence to 720 days for the person sentenced to life imprisonment (AG), as well as the damage to the prestige of the magistrate in particular and the damage to the trust of public to justice.

According to the ILD investigation, in giving the decision, the magistrate did not refer to the facts in the documents of the file, but clearly presented distorted facts and circumstances just to suit the fulfillment of formal legal requirements. In the analysis of the 4-year decision-making of the magistrate (2017-2021), with the object of reducing the sentence, the High Inspector of Justice has concluded that the judge acted differently in giving 155 other decisions, where in 7 requests from those convicted with "Imprisonment of for life" the formal legal criteria have been respected.

At the end of the investigations, the High Inspector of Justice had concluded that the actions/inactions of the magistrate TT constitute a very serious disciplinary violation, which discredit the position and image of the judge during the exercise of his duties, and asked the Supreme Court of Justice to assign the disciplinary measure "Dismissal from duties", for the magistrate for disciplinary violations provided by article 102, point 1, letters "dh" and article 102 point 2 letters "b", "c" of Law no. 96/2016 "On the status of judges and prosecutors in the Republic of Albania".
