Ismet Gaxherr , who was caught with a gun in a car this morning on "Bajram Curri" Boulevard, was involved in the Linza incident in 2015, where Enton Nikaj was shot to death .

It is reported that the 39-year-old was the owner of the bar where the serious incident occurred and a friend of the victim.

Police announcement:

Based on the information provided, on "Bajram Curri" Boulevard, a "Benz" vehicle driven by citizen IG, 39 years old, resident of Tirana, was stopped.

During the search, a firearm, a pistol with ammunition, was found in the vehicle, which the 39-year-old was in possession of without a permit.

Ismet Gaxherri was arrested for the criminal offense of "Unlicensed possession and production of weapons, explosive weapons and ammunition."

THE MURDER of Enton Nikaj:

According to the Prosecution, the defendants had lunch at the "M..." bar on the day of the incident. As they got into the vehicle they were driving there, they saw the owner of the bar, Ismet Gaxherri, and citizen Enton Nikaj, from a distance.

According to the Prosecution, the defendant Ervis Martinaj said, "This guy came who owes me some money." The Court of Appeal claims that there is no evidence to prove that the defendant Martinaj said these words.

Referring to security camera footage and statements from those involved in the incident, Apel states that when Gaxherri saw Martinaj, he addressed him with "Look, what do we have?"

According to the Court, Martinaj told him that he had nothing to do with him and that he had addressed Nikaj, saying, "Hey, kid, come on, just a second."

According to the Court, they clashed with each other, where Nika was beaten by the defendants. At the same time, the other injured party, Gaxherri, was kept kneeling, under threat of several objects that, referring to the images, the Court describes as objects similar to firearms, such as pistols.

While the deceased Nika was being raped by the defendants, the prosecution claims that he was executed in cold blood by them, an act committed by the defendant Emiljano Tasho.

According to the Appeal, the moment of execution was not recorded by the cameras, as it was outside their field of view. Consequently, the Appeal states, the prosecution's claim that the execution was carried out in cold blood, in collaboration with the four defendants, is unfounded in evidence, but simply in the analysis of the defendants' actions.

Referring to the evidence presented in the process and the claims of the parties, the Appeals Chamber assessed that the murder of Enton Nika was committed without premeditation and not in collaboration with the defendants.

"The murder of citizen Enton Nika was committed by defendant Emiljano Tasho, as a result of this defendant's excess, during the time when he, together with the other defendants, were punching, kicking and hitting the deceased Enton Nika and citizen I. Gaxheri with hard objects," the Appeal states.

“The victim had no previous acquaintance with the four defendants and consequently the cause or motive of this murder cannot be identified”, the Appeal reasoned. Regarding the acquittal on the charge of “failure to report the crime”, the Appeal stated that “it cannot be the person himself who was involved in the incident, was taken as a defendant by the Prosecution body and moreover is accused of the criminal offense that he should report, since in this way we would go beyond legal logic and would find ourselves in conditions where the defendant incriminates himself”.
