An Albanian family in the US blames the New York Police Department and emergency services for the death of their father after he was hit by a car in Queens. According to the American media, 70-year-old Genti Frashëri, who lived in Whitestone, died in November, 3 days after being hit by a vehicle while walking on the street.

His family has filed a lawsuit and is seeking $20 million in damages, alleging that he was transported to the hospital nearly an hour late.

"He was swinging his legs and arms, a condition that occurs when someone has a brain injury, which is what happened to him. And instead of immediately sending him to the hospital, they accused him of assault, accused him of a crime while he was lying on the ground with head fractures", said the Frashëri family's lawyer, Sanford Rubenstein.

"If he had been treated with the urgency and care he needed at the time the incident happened, he could have survived," said the victim's daughter, Enika Sopiqoti.

According to the lawsuit, the first ambulance that went to the scene left without taking the 70-year-old because, according to the employee's claim, he punched and kicked her. She requested the help of the police to arrest her and the ambulance left the scene.

More than 50 minutes passed by the first ambulance and when he was taken to the hospital, the Albanian was handcuffed. His family also says he was pronounced clinically dead the next morning, but police insisted on handcuffing him.

As for the allegations that he assaulted the emergency worker, his family says he was moving uncontrollably because of his brain injury.

"Abnormal movements are common in brain-injured patients hospitalized in intensive care units, including those who have suffered traumatic brain injuries," according to an expert study published in 2016. This is also the argument of the Albanian family, which refutes the claims that the 70-year-old attacked the employee.

The family members also add that the hospital staff told them that they had never before seen someone charged with a crime in such a situation. Frashëri went from Albania to America without knowing English. There he built a career as a welder and then retired and continued to work as a security guard in a facility. /Firehouse
