The arrest and imprisonment of several officials and former high officials, on suspicion of abuse of office or corruption, without a sentencing decision, who do not present social danger and who do not hold functions to destroy evidence, has worried the government and the Assembly.

The former mayor of Durrës, Vangjush Dako, was arrested and imprisoned for two episodes of abuse of office alleged by SPAK. The former Minister of the Environment, Lefter Koka, has also been held in prison for 1.5 years, without a conviction.

Former deputy Alqi Blako and former mayor of Bulqiza Lefter Alla are also being held in prison, even though the crimes they are accused of are disproportionate to the prison sentence, an extreme security measure.

The General Secretary of the Ministry of Health, Joana Duro, was arrested and is being held in prison for a 330,000 ALL bribe. Dozens of other citizens and former officials, arrested for abuse of office or corruption, are kept in prison without a conviction.

They are waiting in the cell for the trial process and the decision, where some of them may even be declared innocent. Meanwhile, former minister Fatmir Mediu is being tried in a free state for Gërdec. Former minister Saimir Tahiri was tried in a free state. He served his sentence only after being convicted by the decision of the Appeal.

Former minister Arben Ahmetaj and former president Ilir Meta are being investigated at large, including for money laundering, a much more serious offense than abuse of office.

When the head of SPAK, Alti Dumani, appeared at the Law Commission, a few days ago, for the annual report of SPAK's activity, deputy Fatmir Xhafaj said that the goal is not to put people in prison to make statistics of good, but bringing charges based on compelling evidence.

" Another issue, which the time has come, after three years, for us to start emphasizing here too, is the fact that very good care must be shown in the investigative processes for the implementation of legality, in raising accusations based on evidence and respecting human rights and freedoms, but also in the best application of criminal policies and the principle of proportionality in the security measures and punishment measures required of you. Our goal is not to put people in jail and make good statistics (yes, for those who deserve such a thing), but the main thing is to raise charges based on convincing evidence and fair application of the law " , Xhafaj said.

On June 6, 2023, the Minister of Justice, Ulsi Manja, was at the Laws Commission, where he reported on the monitoring of the implementation of the government's recommendations to SPAK and the General Prosecutor's Office. Among other things, Manja said that it should not be a goal in itself to apply the security measure of "prison arrest" for every criminal offense, since the criminal legislation also provides for other measures, such as the property guarantee, which is rarely applied. The Minister of Justice said that the imprisonment must be proportional to the dangerousness of the offense and the author
