'Big Brother' in SPAK, prosecutors and judges under surveillance by officers of the National Bureau of Investigation

The Constitutional Court will consider on November 19 not only the assessment of whether the intercepts provided by the encrypted Sky and Encorchat applications can be used as evidence, but also an article of a law reforming the law regarding wiretapping.

The lawyers who have taken Sky Eç to the Constitutional Court, have presented an addendum to the appeal, where they demand that, in addition to the review of the legality of the SKY application, the provisions of Article 42 of the law on the organization and operation of SPAK, which puts interception judges and special prosecutors.

The Constitutional Court has agreed to consider this request on November 19. In their reasoning, the lawyers claim that the surveillance of judges and prosecutors makes them blackmailable.

According to Article 42 of the law on the organization and operation of SPAK, judges and special prosecutors are under continuous monitoring by a special unit set up in the National Bureau of Investigation.

The law designates an officer responsible for their supervision, who performs periodic surveillance of the telecommunications of the presidents, judges and employees of the anti-corruption and organized crime courts, the leaders, prosecutors and employees of the Special Prosecution, the Director, Deputy Director and investigators of the National Bureau of Investigation, officers of the Judicial Police services, as well as employees of the National Bureau of Investigation.

The provisions also provide that the surveillance officer is controlled by a special prosecutor who is chosen monthly by lot, and the special officer reports any information that raises suspicions of corrupt or criminal activity to this prosecutor.

In cases where the officer of the National Bureau of Investigation suspects that the willing special prosecutor is involved in criminal activity, he may choose to make the report to another special prosecutor.
