Criminal amnesty is approved

After an odyssey of debates that has continued for weeks, the draft law on criminal amnesty was approved in today's session. Amnesty received 116 votes, after the majority and Reestablishment combined the votes.

Meanwhile, Lulzim Basha's group voted against. According to Basha, the criminal amnesty is "a dirty bargain" between the government and Reestablishment and that it is being used against SPAK: Reestablishment gets the stamp, while SP sends a message to SPAK.

"One side has the problem of the fake label being recognized, the other has the problem of the corrupt officials who are going to jail. So what does this have to do with setting a limit? The message sent to SPAK is that you convict them, we release them. This is how we will save the big fish that benefit from the current conditions", accused Basha.

Earlier in the day, the Minister of Justice, Ulsi Manja stated in the Parliament that 1 thousand 100 prisoners will benefit from this amnesty, of which 700 will be released immediately as soon as the law is in force, while the other 400 will benefit from a reduction punishment.

From this, the amnesty, Manja, has stated that people sentenced to life imprisonment, people who avoid justice, will not benefit from a reduced sentence, nor will people sentenced by the Criminal Code

"This amnesty, in addition to the principles of humanization, also aims to reduce overcrowding in the system, because it creates optimal conditions for the rest of the detainees. This amnesty benefits 1,100 people sentenced to imprisonment, of which 700 will be released as soon as the law comes into force, while another 400 will benefit from a reduced sentence, 2,700 people on probation will be the beneficiaries of this the amnesty that will be voted on tonight. From this amnesty, people sentenced to life imprisonment, people who avoid justice, will not benefit from a reduction of sentence, because there is no question of criminal prosecution.

The people who received a final decision by 31.3.2024 will benefit. This is part of the amendment proposed by Bardhi. Men who have served less than 4 years, or who have been sentenced up to 4 years, women who have served up to 5 years or who have not served 5 years from their sentence benefit from the amnesty, minors, women who are 50 or over 50 years old, men 60 or over 60 years old, people who have been equal to or under 18 years old. This law also has relevant limitations. In this draft law, only 5% of the criminal offenses that this code has, this law extends the amnesty for 95% of the other offenses of the criminal code will not be under the effects of this law.

For the category of subjects that do not benefit from the amnesty, we have a provision for reducing the sentence. It was 1 year for men and 1 and a half years for women. We have accepted Bardhi's amendment proposal to reduce the sentence to 1 and a half years for men and 2 years for women, as a mitigating measure. Regarding criminal prosecution, for light criminal offenses the limit of criminal misdemeanor with crimes has been maintained, maximum up to 2 years that will be included. This amnesty extends to criminal prosecution for misdemeanors only. This measure is appropriate to end the criminal prosecution for the cases that are still under consideration without taking a final form. From the criminal prosecution will be excluded all reports that are in the bodies for certain types of criminal offenses for the demonstrations developed until March 31, 2024. For the opposition protesters, regardless of time divisions, but for a category of offenses related to this category, we will have a break in criminal prosecution at any stage of the investigation or trial.

There are 232 criminal cases that will benefit from this amnesty as far as criminal prosecution is concerned. The number of people who benefit from this amnesty is several times because there is a criminal case with 10 or 20 people who were under investigation or trial. There are 42 convicted women and 27 minors and 31 women are under medical measures because they have committed a criminal offense, but they received medical measures due to their serious condition. 11 women benefit from the amnesty with immediate release. The number of women who benefit from the reduction of the sentence, increasing the limit from 1 year and a half to 2 is very large. By September, a significant number of women and girls are released. 11 minors are released immediately ," said Manja.
