The Council for Regulation, Mandates and Immunity will present two different reports for voting in the Assembly, as the request of the Democratic Party to take the issue of the removal of the mandate of the socialist deputy Olta Xhaçka to the Constitutional Court was rejected.

DP MP Gazment Bardhi said that the socialists have decided to "protect their colleague", but he further underlined that the DP will send the matter to the Constitutional Court to resolve the conflict of powers.

Meanwhile, according to the SP deputies, the Assembly has no constitutional reason to take the DP's request to the Court.

"We come to the conclusion that there are no issues that the Assembly should send to the Constitutional Court for consideration. The submitted requests do not meet the criteria of the Constitution. The Assembly does not discuss the reports during the session, the constitution and regulations say so," said MP Bushka.

PD accuses that Minister Xhaçka is in a conflict of interest regarding a decision of the Council of Ministers.

The opposition claims that her husband is behind a company that will build a tourist resort on the coast of Himara in the capacity of a strategic investor.

Debate:

Gazment Bardhi:  I and the majority colleague have not agreed on a joint report that the majority colleagues have decided to protect the minister and their colleague Olta Xhaçka. The position of the opposition has been that the Constitutional Court should examine this issue on its merits.

We do not decide whether or not a deputy has exercised his mandate in violation of the Constitution. What we and the Assembly decide is to be forwarded to the GJK for review. I assure my colleagues that the case will be sent for resolution of the conflict of competences to the CJK and we will meet again here after the decision of the CJK that will force you to send it to the CJK in this case.

You have in your hand the force of cardboard to delay this issue but you will never prevent the application of the law equally for a deputy of your parliamentary group, for a minister who, taking advantage of the position of deputy and minister, has decided to do her millionaire husband.

Klotilda Bushka:  Is the Assembly in the conditions to turn to the Constitutional Court to examine the issue?

These are not the conditions for setting the Constitution in motion. We come to the conclusion that there are no issues that the Assembly should send to the Constitutional Court for review.

The submitted requests do not meet the criteria of the Constitution. The Assembly does not discuss the reports in the session, the Constitution and regulations say.
