Law on the Financing of Political Parties, Venice Commission gives its opinion on Albania: Some adjustments are suggested

The Venice Commission and the General Directorate for Human Rights and the Rule of Law (DGI) have positively assessed the draft law "On the Financing of Political Parties", which was sent for review by the Albanian Parliament.

In their opinion, international experts welcome the fact that the draft law was drafted through an inclusive process, with the participation of the majority, the opposition and civil society, and represents a significant improvement compared to the current legislation.

According to the Venice Commission, the draft law aims to increase transparency, accountability and integrity in the financing of political parties. Positive elements include more detailed financial reporting, the use of electronic platforms, strengthening control and audit mechanisms, clearer regulation of prohibited sources of financing and the creation of a special structure within the Central Election Commission.

However, experts emphasize that the draft law needs further improvements to address gaps and weaknesses identified over the years. They assess that the provisions should be clearer and more detailed, while technical rules should be left to sub-legal acts.

One of the main concerns is related to the indirect and secret financing of political parties through affiliated organizations, third parties, digital platforms, communication agencies, in-kind services or the use of public resources.

The Venice Commission also recommends harmonizing the rules on party financing with those on election campaign financing, strengthening the powers and independence of the CEC in supervising political financing, and reviewing the system of sanctions for violations of the law.

According to the opinion, future reforms to the Electoral Code should close any remaining gaps and ensure a complete and sustainable framework for political financing in Albania.
