Law of war with Greece, PDIU submits to the assembly p/statement: Legal and

The PDIU parliamentary group demands the abolition of the absurd law of war with Greece

The parliamentary group of the PDIU "Justice and Integration" declared from the Parliament of Albania and requested today, through a project-declaration, that the governments of the two countries start the initiative for the abrogation of the absurd Law of War, putting an end to the Balkan schizophrenia that Greece maintains with Albania for 84 years.

Accompanied by the chairman of the parliamentary group, deputy Mesila Doda and deputies, Nustret Avdulla and Gëzim Ademaj, the chairman of the PDIU, Shpëtim Idrizi, declared before the media that:

"The statement is also evidence of our peaceful but determined policy to find a solution after 84 years, regarding a legal absurdity based on a historical absurdity.

The dialogue between our two countries must be concrete, with demands of real value and inexhaustible over time.

However, it is regrettably noted that unlike the spirit and letter of the Treaty of Friendship, Cooperation, Good Neighborhood and Security, in open violation of many of its articles;

Despite the political will repeatedly expressed publicly by senior representatives of Greece, negotiated solutions to repeal it and address its legal consequences, Law of War no. 2636/40 still remains in force and continues to produce some of the negative effects that arise when states are at war.

The law in question is obviously an absurdity!!

In 1999, the Greek Ministry of Foreign Affairs stated in an official letter to the Ministry of Foreign Affairs of the Republic of Albania that Law 2636/40 is in force.
The foreign minister of Greece, Kotzias, said that the Law of War "is a historical stupidity, which must end. There should not even be a formal doubt that the two countries may be in a state of war. This is the main issue that must be resolved positively".
Likewise, the foreign minister, Dendias, during his visit to Tirana, stated that: "As for the law of war... This thing is an anachronism, I am sure that we will solve this together. And it is a great joy for me that I have the opportunity to say this here, from Tirana, by order of Prime Minister Mitsotakis".
He declared that the procedures for the abrogation of the law, which dates back to 1940, will begin.

This law has important implications in limiting the fundamental rights of Albanian citizens and is an act that keeps alive the irredentism of certain Greek extremist circles.

On October 28, 1940, the Kingdom of Greece declared the Law of War with decree 2636, followed by a series of other laws part of the Greek legal system.

The demands presented in this statement have a legal, non-territorial and non-historical basis.

The full statement presented to the Parliament of Albania:

"The Assembly of Albania, appreciating the great importance and very good level of bilateral strategic relations with Greece, as well as the mutual will to improve and deepen them for the benefit of our two countries and peoples, as well as the contribution to strengthening of peace, security and cooperation in our region.
Bearing in mind that our two countries are members of the North Atlantic Treaty and in this context cooperate without reservations to guarantee our common security and defense.

Taking note of the joint contributions of our countries to cooperation organizations for peace, security and human rights, primarily OSCE and CoE.

Appreciating Greece's contribution to the advancement of the integration processes in the European Union of the countries of the Western Balkans, and the cooperation in the relevant regional organizations.

Bearing in mind that the "Treaty of Friendship, Cooperation, Good Neighborliness and Security" was signed between the Republic of Albania and the Republic of Greece.

Taking note that the relations between our countries have progressed positively and that both countries, in the spirit of understanding and for the benefit of our two peoples, have cooperated to resolve the open issues between our countries.

It is noted that, contrary to the spirit of the "Treaty of Friendship, Cooperation, Good Neighborliness and Security", as well as the bilateral political will repeatedly expressed, the Law of War No. 2636/40, still remains in force and continues to produce some of the negative effects that arise when states are at war;

With the intention and desire to solve this issue inherited from a past that cannot be returned,

ASSEMBLY OF THE REPUBLIC OF ALBANIA

- Convinced of the good will of the Parliament of the Republic of Greece to give positive impetus to bilateral relations with Albania, making constructive efforts to resolve any open issues,

- Invites the Parliament of the Republic of Greece to support the efforts of their government for the implementation of the political will expressed more than once by the Foreign Ministers of the Republic of Greece for the abrogation of the Law of War No. 2636/40 with Albania, and in this positive spirit to consider and approve any legal instrument that would serve to correct this situation that does not match the realities of bilateral relations between Albania and Greece.

- In accordance with the interparliamentary engagement provided for in the Treaty of Friendship, Mutual Cooperation, and Security between the two countries, we call for the creation of a working group between the two Parliaments to officially contribute in this direction, or in addressing any similar problem in relations between our two countries according to the recognized principles of international cooperation.

Also,

ASSEMBLY OF THE REPUBLIC OF ALBANIA

- Requests the Council of Ministers of the Republic of Albania to make every effort with the government of Greece for the abrogation of Law No. 2636/40, and the legal consequences arising from this law.
