The Special Court of Appeal has ordered the immediate release from detention of Kristi Bixheku, who was accused by SPAK as part of Laert Haxhiu's group. The decision was made on the grounds that he had already completed the sentence imposed by the first instance court.
The appeal accepted Bixheku's request, found the termination of the security measure "arrest in prison" and ordered his immediate release, on condition that he is not held in prison for any other case or sentence. SPAK has been charged with implementing the decision.
Kristi Bixheku was arrested in the Netherlands on March 4, 2025, as part of the procedure for his extradition to Albania. On March 14, 2025, he was extradited and continued to be detained in Albania.
According to the reasoning of the Special Court of Appeal, the period of detention in the Netherlands for extradition purposes should also be counted towards the time of detention.
Bixheku was sentenced by the Criminal Court of Kosovo on June 9, 2026, to 3 years and 6 months in prison for the criminal offense of “Supporting the perpetrator of a crime.” Due to the summary trial, his sentence was reduced by a third, to 2 years and 4 months in prison, or 28 months.
The appeal also applied the rule that one day of detention is counted as one and a half days of imprisonment. According to the court's calculations, the 28-month sentence was completed on September 24, 2026.
On October 3, when the Appeals Court reviewed the request, Bixheku had served, according to the court's calculation, 2 years, 4 months and 12 days of imprisonment.
An important element of the decision is the fact that the sentence handed down by the GJKKO on June 9 had not yet become final, as the case had been appealed and was in the Appeals Court.
However, the Appeal reasoned that this circumstance cannot justify the continuation of the deprivation of liberty, at a time when the time of detention calculated according to the law had exceeded the sentence imposed by the first instance.
The court referred to Article 261/1, letter “c” of the Code of Criminal Procedure, according to which the security measure is terminated when the duration of detention is greater than the amount of the imposed sentence.
For this reason, the Appeal has ordered the immediate release of Bixhek, if there is no other measure or sentence against him that prevents his release.
The case against Kristi Bixheku is related to criminal proceedings no. 227/2023 of SPAK. In the framework of this proceedings, he was charged, among other things, with “Destruction of property with explosives”, “Structured criminal group”, commission of criminal offenses by a structured criminal group, unauthorized possession and production of weapons, explosives and ammunition, as well as providing conditions and material means for committing murders.
The file mentions episodes that occurred in Lushnja, including the events against Bujar Turku and Resmije Turku, as well as an episode related to Genci Hilda.
However, the First Instance Court of Criminal Appeals declared Bixheku innocent of some of the main charges, assessing that their commission by him was not proven.
In conclusion, the criminal liability for which he was convicted was "Supporting the perpetrator of a crime", a sentence that after the application of summary judgment was reduced to 2 years and 4 months of imprisonment.
With the latest decision, the Special Court of Appeals found that this time had expired and ordered his immediate release.
