Amid the noise of the Conference League final, the Government has passed by normative act the decision to compensate tender companies for raising the prices of certain building materials.
The normative act was taken at the government meeting dated 18 May, but has not been published on the prime minister's official website, while it was published in the Official Journal on Monday.
Through this decision, companies that have won public contracts in tenders have the right to seek compensation for the price increase for iron, cement, bitumen, aluminum, copper and zinc.
The normative act applies to public contracts for jobs financed with funds of state-owned societies at least 51 percent, or with foreign financing, that are afforded by funds of state-owned societies, which are under way to be linked before the enactment of this normative act, or in the process of implementation since 1 January 2020 and affected by the increase in the prices of these materials.
The normative act does not give a figure of how much additional money the tenders will cost Albanians, but the most minimum figure is estimated at about 60 ml n euros. Private companies are entitled to claim compensation of between 5 and 30 percent of the total cost of purchasing these building materials.
For public contracts for work, to be bound after the entry into force of this normative act, contractor authorities must refer to market prices for iron, cement, bitumen, plastic tubes and in the case of state-owned societies at least 51 percent, including aluminum, copper and zinc.
The request for compensation is made through a form, which if approved by the contractor authority is reflected as additional to the initial contract. However, this addition under the normative act will not be named part of the contract.
Companies that do not agree to the value of the compensation offered by the government will be excluded from tender competitions for 3 years, while the signed contract will be cancelled and the procedure for continuing to work is reopened.
If the economic operator does not agree to the established value of compensation by the contractor authority, the contract between the parties is resolved and a new procurement procedure for the realization of unfinished works is reopened. Also, the economic operator takes the measure of exclusion from procedures for the benefit of public contracts for a period of 3 years by the Public Procurement Agency.
