He presented before the Supreme Prosecutor's Council the annual report of the work of the structure he heads, where amid concerns raised by KLP members there was also one that was indirectly linked to the quality of the SPAK investigations.
KLP member Tartar Bazaj asked The Kraja if it seemed normal for the state police to degrade into charges and convictions only for abuse of office in the SPAK and the Special Court.
Kraja defended herself, saying SPAK has not launched any investigation into abuse of office. "If you tell me a case, I resign" was his bet, adding that the structure he runs has seized 70 ml euros of criminal asset.
The head of the SPAK may be right in this part. So, the SPAK has not launched any investigation for abuse of office. The structure, considered the heavy artillery of the Albanian justice system, cannot waste energy on human and financial resources only on such common charges.
The primary for SPAK should be organised crime and corruption of high levels. The charges that arise in these cases are multiple, and in the case of corruption there is also abuse of office, but as supporting and procedural accessory to prove guilt.
However, there are times when the SPAK fails to prove, or convince the Special Court, of the heaviest charges it charges against subjects under investigation, and all monthly and often several-year investment has been made into a sentencing decision for abuse of office.
The case is that of former Interior Minister Salvini Ramadan. The charges against him were inherited by the former Prosecution for Serious Crimes. Among them were two charges, that of drug trafficking within a structured criminal group and corruption charges.
But the former Serious Crimes Tribunal sentenced Ramadan in September 2019, three months before SPAK was founded, with three years in prison being turned into probing service for the former minister. By knocking down all charges brought by prosecutors and reassessing the charge only in 'abuse of duty'.
The decision was decided and the case was transferred to SPAK and GJKKO after December 2019, when the former Serious Crimes Prosecution merged. From this period, SPAK took over the full file and with it the opportunity to reassess the charges and correct and fill out the file with elements that would give it right in court.
But two years it was not enough for SPAK to find the evidence necessary to convince GJKKO of corruption and drug trafficking charges, and in February this year, the former minister was again convicted only of abuse of duty.
