The law on the organization and functioning of the Constitutional Court defines in its article 7 the criteria that must be met by the candidates to be elected members of this court.
In point 2 of article 7 fraction A, the law states that among the criteria that candidates must meet is at least 15 years of work experience as a judge, prosecutor, lawyer, professor, or law lecturer, or lawyer at the level of high in public administration.
The criteria are clear at this point. But what is unclear from the biography of the newly elected member of the Constituent Assembly, Holta Zaçaj, is whether she fulfills them or not.
In the biography submitted by her to the Judicial Appointments Council, Zaçaj does not specify with concrete dates her experiences as a lecturer, high-level lawyer, or lawyer. From a general overview of the biography, the impression is created that she fulfills the seniority criterion of 15 years, according to the criterion established in the law on the organization and functioning of the Constitutional Court.
She declares that in 2008-2009 she trained judges and prosecutors on the implementation of the Family Code, the civil code and civil procedures from the perspective of children's rights at the School of Magistrates.
Furthermore, she declares a series of experiences in Albania and abroad as a high-level lawyer and jurist.
But, although it is stated in the biography that she has practiced the profession of lawyer for years, the tax system shows that Holta Zaçaj has not paid any contribution in the form of taxation for the profession practiced.
Even in the National Business Center, if you search for Holta Zaçaj's name, there is no activity registered with NIPT to reinforce her experience as a lawyer.
