Government project/ Restaurants and markets forced to enter into a contract for

Restaurants and canteens that produce food for direct human consumption are obliged to conclude a cooperation contract with a licensed operator for the collection, processing or elimination of by-products of animal origin when they are not deposited as waste. Supermarkets or trading units that remove from the market food that cannot be used for humans will have the same obligation when it is damaged, spoils, expires or is not sold.

The new draft law submitted for consultation by the Ministry of Agriculture on "By-products of animal origin" also imposes an obligation on licensed business operators for animal breeding, animal slaughter, fish breeding, fish processing, etc. to connect a contract with a collector of animal by-products, plant or establishment licensed for the processing and/or disposal of animal by-products.

According to the draft, the conclusion of the contract is a condition for licensing the primary activity. Failure to provide a contract for these business operators within 18 months from the date of entry into force of this law constitutes a reason for the immediate removal of the license for exercising the primary activity.

Referring to the draft law, these measures will affect the protection of the environment since the by-products have a potentially negative impact on its pollution if they are not collected, processed and distributed properly.

The draft also defines coercive measures against violators of the law, with administrative penalties, while violations that constitute a criminal offense are punished according to the Criminal Code in the Republic of Albania. The document defines the "polluter pays" principle, that is, damages that have a financial value to any entity, state or private, are paid by the individual or entity that causes it.

Administrative fines range from 10,000 to 2,000,000 Lek depending on the violation committed by the operators, such as trading, licensing, import or export.

The draft law is intended to be approved in 2024, but it is expected to extend its effects from February 1, 2026, in relation to the entry into force of other laws in the process of approximation that are related to it, which are also intended to be approved during 2024.
