Two deeply serious and openly unjust events, with a radical political background, at the same time with extra institutional suspicions, are taking place in the General Prosecutor's Office, that of Tirana and the Special Prosecutor's Office.

We take you in turn.

First

The announced appointment of Arens Çela as the head of the Tirana prosecution, at the time when vetting was still taking place, former prosecutor Elisabeta Imeraj and there was no final decision by the Special Appellate Panel.

Secondly

Disruption of the competition conducted by KLP, for the selection of two prosecutors in the Special Prosecution, namely that of Elvin Gokaj and Alfred Shehu

There are many occurrences behind the curtain. Let's start from the beginning.

The High Council of the Prosecution seems to be taking steps according to forecasts that are not completely unknown. On the day of Imeraj's dismissal, he issued the decision to command Çela in her place and then comes the race for the appointment. Nothing new from the justice front. The political director and the dubious one, work together to enable the post at the head of the Prosecution, according to the promises and not the competitions.

The KLP had announced that today there would be a hearing to review the alleged candidacies of the head of the Tirana prosecutor's office. Two names of prosecutors. Kreshnik Ajazi and Arens Çela. How it happens in the tender. The disliked firm finds a stunt and is disqualified, perhaps deliberately knowing it unspoken publicly. Kreshnik Ajazi, was disqualified by KLP, which has made a decision. Considering his application in the competition inappropriate, because he is a prosecutor of the Prosecution at the Court of First Instance Elbasan. In no legal reference to the new justice, this legal patch is mentioned, nor is it stated by the Council in the technical details of the clarification. The other set, as servile as it is unsupported by law, is the presence at the invitation of the HJC of the representatives of the Ministry of Justice, OPDAT and the General Prosecutor, the latter in apparent conflict of interest, that he was taking part in the election of his subordinate. Even from OPDAT assistants, it seems that they are a couple under supervision, completely legally unnecessary. Ajazi, disqualified for a reason not supported by law, can send his appeal to the Court for this decision of the Prosecution Council, and return the Tirana race, which is closing with the haste of anonymous interested parties. But Ajazi knows how to obey, because he has given evidence. may send his appeal to the Court for this decision of the Prosecution Council, and return the Tirana race, which is closing in a hurry to anonymous interested parties. But Ajazi knows how to obey, because he has given evidence.

Secondly

Invalid competition in the High Prosecution Council for the two winning prosecutors elected to be prosecutors of the Special Prosecution, Alfred Shehu and Elvin Gokaj. A few days ago, the Court of Administrative Appeals accepted the request of the prosecutor of Tirana, Sonila Muhametaj, for the review of the competition for appointments in SPAK. The prosecutor sued the High Prosecution Council, requesting the invalidity and null declaration of the appointment of Elvin Gokaj and Alfred Shehu, because according to her, the scoring was given without merit. The arguments that convinced the court presented by Muahmeti were focused on the facts that Elvin Gjokaj and Alfred Shehu won the race under deliberate preferences, where one of them was incompetent, a finding in vetting, as he had to return to the Magistrates. The other did not investigate the file of the electoral murder in Elbasan.

But where does the rabbit sleep?

In fact there is a rabbit tent there. Prosecutor Muhametaj as a complainant may be fully entitled to her allegations. The decision was made by three presiding judges Altina Nasufi and members of the panel Blerona Hasa and Rilinda Selimi, one still in the process of re-evaluation.

But there is an unspoken and unmentioned fact, which it would be good to emphasize somewhere in the court hearing. Because there is influential weight in these developments. Elvin Gjokaj is one of the 17 prosecutors in the Special Prosecution. There was a referral to the Prosecutor for the public commissioner Florjan Ballhysa, for declarations of tax payments which require an investigative filter. Another member of the body of the Independent Qualification Commission is under investigation for inaccurate declarations about assets. The vetting controllers have found themselves in the face of trouble to be investigated. This has led to a reaction of nationals and internationals part of the veto bodies, at the same time of the supporting policy. Political controllers were found uncovered. Prosecutor Elvin Gjokaj, after reviewing the reference materials, has decided to register the criminal proceedings against Florjan Ballhysa and he must face the SPAK for the allegations against him. The prosecutor has decided to do his duty, not being influenced by the great pressure on him, to bypass this file with extravagant temperature and interest. Now, in order to remove the file from Gjokaj's hands, there is no possibility to just remove it from the Prosecutor's office. Schemes are always an option. The reopening of the competition, following the decision of the Administrative Appeal, is the most credible, at least publicly. This does not make Muhametaj's claim unfair. Not only the three prosecutors, Elvin Gjokaj, Alfred Shehu, Sonila Muhametaj, but also many others can re-enter the competition. Then the scores in the High Council of the Prosecution, can be reformatted and be an anti-stress for Ballhysa and the case against him.

The question is, will the criminal proceedings against Ballhysa remain standing even if there are inversions in the expected scoring ?! The new justice grew old, without consuming youth at all…
