Lawyer Ylli Manjani has reacted to the decision of the Court of Cassation in France, which has questioned the legitimacy of using SKY ECC data as judicial evidence.

According to Manjani, this development paves the way for review at the European Court of Justice, while in Albania the courts "refuse" to apply the same standard of legality.

Even the French judiciary itself is divided over the SKY ECC case.

A joint appeal by three lawyers from Germany, the Netherlands and France to the French Court of Cassation has managed to convince the French judiciary that the issue of the use of SKY ECC data by other countries, including those outside the EU, deserves serious consideration.

"The originality, reliability and legitimacy of this data from other countries becomes impossible"...

On this premise, the French Court of Cassation has accepted the logic and referred further judgment to the European Court of Justice. The latter had previously set the benchmarks for the control of legality by the host courts. A task that our courts refuse to do because SPAK does not like it!!!

But what is more interesting is that in June 2025 the Court of Cassation in France issued a decision stating that:

"The digital investigation in other countries should have been preceded by the prior notification that should have been made in these countries. In the case of SKY ECC, this did not happen."

So in short, the Supreme Court of France has paved the way for the use of SKY ECC data as judicial evidence to be overturned.
