Ervis Martinaj and Jeton Lami

The decision that left former policeman Jeton Lami, the bodyguard of the much-wanted Ervis Martinaj, in prison has been clarified.

Although he claimed that isolation in a cell could endanger his life due to his profession, the Supreme Court overturned the appeal submitted on February 7, sending Lamin to trial for abuse of office.

The investigative file describes some of the moments when Martinaj was last seen on the hotel cameras in Durrës and the accusations against former police officer Jeton Lami.

The file also shows that a 22-year-old woman who was one of Martinaj's last contacts before his disappearance was also questioned.

According to her statements, before the disappearance, Ervis Martinaj had contacted her on the Instagram social network with an address "King Simba" with a profile picture of his lion, and there the communication between the two had started.

On August 5 of last year, Jeton Lami was driving an Audi-A8 vehicle with foreign license plates and accompanied the most wanted man from Tirana to a hotel in Durrës and after police investigations he was identified and escorted to prison.

"19. The Criminal Panel assesses that none of the claims raised in the appeal refer to the causes of appeal provided by 432 of the Code of Criminal Procedure. The part of the claims in the appeal that raises issues of evaluation of the evidence is outside the exclusive legal jurisdiction of the Supreme Court. In all cases where the recourse does not comply with the reasons defined by article 432/1 of the Code of Criminal Procedure, the Penal College decides not to accept the recourse. The position held by the College for the case under consideration is also based on the consolidated jurisprudence of the Criminal College of the Supreme Court, which refers to the jurisprudence of the Constitutional Court and the European Court for Human Rights, according to which the causes presented in the recourse resulting clearly unfounded are assessed as inadmissible for the acceptance of recourse.

20. The Criminal Board assesses that none of the claims presented by the applicant refer to the causes of recourse provided by Article 432 of the Criminal Code. The College assesses that the Tirana Court of Appeal has justified its decision-making and there are no reasons for violating it. Also, the College does not find any violation of material or procedural criminal law by the Court of Appeal.

21. As above, the Criminal College of the Supreme Court, assesses that the recourse presented by the petitioner Jeton Lami against the decision no. 801 dated 20.09.2022 of the Tirana Court of Appeal does not contain any of the above-mentioned reasons and therefore cannot be accepted", the decision states, among other things.
