Can an energy project, which aims at export to the free market and not Albania's domestic needs, receive the status of "Strategic Investment"? And further, can this happen on land with a Bonitet 2, among the most fertile in the country?

The case of the 170 MW Roskovec TPP is becoming a dangerous precedent where the law is being used to "legalize" the destruction of food security in the name of private profits.

1. The "Public Interest" Paradox

According to the law, an investment is considered strategic when it serves the general national interest. But in the case of Roskovec, the stated goal is the free market.

Loss : Albania permanently loses entire hectares of fertile land (Bonitet 2).

Profit: The private company sells the energy abroad.

The waste: The residents of Roskovec are left with CO2 emissions (60-75 tons/hour) and an infrastructure that does not serve them, but international stock exchanges.

2. Property 2: Land that cannot be concreted

Law No. 9244 "On the Protection of Agricultural Land" is clear: the lands of the first categories are national assets. Changing the destination is allowed only in "emergency" cases and when there is no other alternative.

When this TPP is built for the free market, any claim of "emergency" falls apart. Why should the breadbasket be sacrificed to fill the wallet of an investor who will sell energy in the region?

3. "Carbon Lock-in" and deadline fraud

The Organic Agriculture Association (OAA) has already documented the violations that bring down this project:

Expired Environmental Statement: As of November 14, 2025, the project no longer has environmental legal coverage.

Fraud with the Start of Works: The false declaration of the start of works on November 3, 2025 was a desperate attempt to keep an expired permit alive.

The 49-year-old trap: This project "locks" Albania to gas by 2075, openly violating the EU's Cluster 4 and the latest WMO (World Meteorological Organization) warnings about the climate emergency.

4. The alternative that is being ignored

OAA has proposed the Agrivoltaic model. This model allows the investment to be truly strategic: it produces energy on top of solar panels, while agricultural production continues underneath them. This is the only way to protect the fertility of Bonitet 2 and ensure clean energy without concretizing the future.

Conclusion: If the state allows the fertile land of Roskovec to be destroyed for a project that serves the free market, then the "Strategic" status has become a license to harm the national interest./ Mjedisi.al
