Following the criminal complaint filed with SPAK against him, the Secretary General of the Ministry of Finance and the heads of 16 Treasury branches, the Minister of Finance, Petrit Malaj, has reacted by defending the institution's position on the payments of judges and prosecutors.
Twenty court clerks in the country, along with the heads of the Union of Judges, the National Association of Judges, and the Association of Prosecutors, filed a criminal complaint with SPAK on September 8, requesting an investigation of Malaj, Gentian Këri, and Treasury branch managers for the blocking of salaries for the month of August.
In his reaction, Malaj considers the situation as an escalation of the conflict between the judiciary and the executive, while saying that the Ministry of Finance has acted in accordance with the law.
"To be reported for enforcing the law, by the guarantors of equality before the law!", writes the minister.
According to Malaj, the reason for the blockage is related to the fact that the Ministry of Finance has refused to execute the requested salary increases without a new decision by Parliament.
"We have refused to open the doors of the state treasury to extract from there, without a decision from parliament, a considerable volume of money, as a salary supplement for judges and prosecutors," he says.
The Minister emphasizes that the government and representatives of Parliament have publicly stated that the implementation of the Constitutional Court's decision on magistrates' salaries will not be hindered.
According to him, the issue is expected to be addressed on September 17, when the adoption of the law that will give the Ministry of Finance administrative powers to act in this regard is expected.
"No one will prevent the addressing of the salary issue according to the decision of the Constitutional Court. This will happen on September 17, when the law that gives the Ministry of Finance the administrative right to act is approved," Malaj declares.
He states that, despite this, representatives of the judicial branch have chosen to escalate the clash through criminal charges.
Malaj's full statement:
To be reported for enforcing the law, by the guarantors of equality before the law!
Today, a criminal report was filed at the Ministry of Finance against me as the head of the institution, the Secretary General, and the treasury directors throughout Albania.
Reason: We have refused to open the doors of the state treasury to extract from there, without a decision from parliament, a considerable volume of money, as a salary supplement for judges and prosecutors.
I do not want to engage in any controversy with anyone or clarify the position of the Ministry of Finance, while it has been publicly stated by the Albanian government and representatives of Parliament that no one will prevent the addressing of the salary issue according to the decision of the Constitutional Court. This will happen on September 17, when the law that gives the Ministry of Finance the administrative right to act is approved.
But this has not prevented representatives of the judicial branch from escalating the conflict with the executive branch by signing a criminal complaint that will surely go down in history.
Meanwhile, today I want to let citizens know how much the request of the honorable whistleblowers costs, according to the salary scale:
First Instance Judge
It is: 376, 381 Lekë
Requested: 567,421 Lekë
Judge of Second Instance
It is: 388,927 Lekë
Requested: 586,335 Lekë
Judge of Group III at the GJKKO
It is: 659,920 Lekë
Requested: 994,877 Lekë
The total effect on the state budget with these demands is an additional 40 million euros, every year. But it doesn't end there.
Magistrates are requesting a salary review for the period 2023-2026 with an effect on the state budget of 125 million euros.
Meanwhile, I say to the Treasury directors throughout Albania and to the Secretary General, who were reported today along with me, that they must continue to perform their duties calmly and without being intimidated, always rigorously safeguarding the state's finances, guided by the law.
