Strasbourg rules in favor of Ferdinand Elezit: Vetting dismissal, unfair
Ferdinand Elezi

The European Court of Human Rights has decided to overturn the vetting of former prosecutor Ferdinand Elezi.

In its legal confrontation with the Albanian state, Strasbourg stated that after reviewing all the documentation and claims of the parties, it concluded that Elezit's dismissal from the vetting process was unfair.

In the decision published on June 23, 2026, the court concluded that Elezit's removal from the justice system was not a necessary measure in a democratic society and that the Albanian authorities had failed to prove the proportionality of their decision.

According to the court, the former prosecutor had successfully passed the background and professionalism check and could not be removed from the system solely for serious methodological errors in income.

In addition to finding a violation, the court ordered the Albanian state to compensate the former prosecutor for the moral damage it caused him, as well as legal costs.

With today's decision, Strasbourg paves the way for Elezit to return to the justice system, reopening the vetting process and re-examining his case in accordance with established standards.

Elezit's victory in Strasbourg comes from the highest European instance for the protection of human rights and raises questions about the proportionality of some decisions taken during the process of re-evaluation of judges and prosecutors in Albania.

Who is Ferdinand Elezi?

Ferdinand Elezi was born on November 12, 1968 in Peqin.

He graduated from the Faculty of Law of the University of Tirana, and later completed his Master of Science and Doctorate studies at the same university.

His career in the justice system began in 1997 as a Judicial Police Officer at the Durrës Prosecutor's Office.

In 1999, he was appointed head of the Kavaja Prosecutor's Office, a position he held until 2003.

He then headed the Durrës Prosecutor's Office, while from 2005 to 2006 he served as head of the Prosecutor's Office at the Tirana Court of Appeal.

From July 2006 until the start of the vetting process, Elezi served as the head and prosecutor of the Prosecution Office at the Durrës Court of Appeal.

During his career, he has been highly evaluated in periodic professional assessments, and has also served for over 10 years as a lecturer at the Faculty of Law in Tirana, and holds the degrees of associate professor and doctor of sciences.

On April 9, 2019, the Independent Qualification Commission decided to dismiss him from office, the decision being upheld by the Special Appeals Panel on September 30, 2020.

After nearly six years of legal battle, the European Court of Human Rights has concluded that the dismissal measure was disproportionate, vindicating former prosecutor Ferdinand Elezi in one of Strasbourg's most important decisions on the Albanian vetting process.
