The European Court of Human Rights (ECHR) has ruled against the Albanian state in the case of the dismissal of prosecutor Gentian Osmani, finding a violation of Article 8 of the European Convention on Human Rights, which guarantees the right to respect for private and family life.

Osmani was dismissed from office in 2019 by the Special Appeals Chamber, following an appeal by the Public Commissioner, who had opposed the decision of the Independent Qualification Commission that had previously confirmed him in office.

Osmani served as a prosecutor in the former Serious Crimes Prosecutor's Office and was also part of the list of candidates for the High Prosecutorial Council.

Albanian authorities had ascertained a lack of legitimate financial resources for several years (2011 and 2013), concluding that the family had not fully justified the declared expenses and savings.

However, the Strasbourg Court found his dismissal disproportionate, stressing that the main problem was related to the formal way of declaring savings and not to sufficient evidence of illicit wealth or concealment of assets. The Court also noted that his wife, who was subject to a similar assessment, was confirmed in office, which raised questions about the consistency and proportionality of the decisions of the Albanian authorities.

In its decision, the ECtHR found that the prosecutor's dismissal had serious consequences for his private and professional life and was not sufficiently justified in relation to the aims of the vetting process.

As a result, the court ruled that Albania had violated Article 8 of the Convention and ordered compensation in the amount of 6,000 euros for non-pecuniary damage and 5,000 euros for legal costs. The court also recommended that, if requested by the applicant, the Albanian authorities consider reopening the vetting procedures in accordance with the standards of the European Convention.
