In January 2018, the show Fiks Fare aired the negotiations between a police officer and a citizen about trafficking and selling cocaine.

The officer promised the informant 200 grams of cocaine. He wanted to give the drug to him for a debt between them for the construction of a gas station in Berat. After the broadcast, the officer was declared wanted and even charged in another case. But, the matter fell apart.

First, he investigated Serious Crimes, then the Prosecutor's Office of Kavaja and finally the Prosecutor's Office of Berat. The latter requested the dismissal of the case. The case went to the Appeal of Vlora, where the re-investigation was initially decided. Later, the whistleblower had a falsified claim and the case was closed in the Vlora Appeal only by procedure.

After this decision, officer Julian Balliu has returned from the escape to the State Police, even with the same ranks despite the fact that the case is in the Supreme Court.

In the editorial office of Fiks Fare, RM complained again, who said that this matter has not been investigated.

"They wanted to fire him. The prosecutor of Berat, Dritan Gripshi, sent him to the court for leave on the grounds that 'he was not in the working hours'. We appealed and there have been 2 trials in the Appeal of Vlora. In the first trial, Appel returned the case for reinvestigation and left the task to the prosecutor. Berat prosecutor's office did not investigate. He went to court again with the same reasoning to dismiss the case. We appealed to the court again. The second trial was held in the Appeal of Vlora and at this time something strange happened. And this is the reason why I turned to the show Fiks Fare", says the whistleblower.

He claims that in January 2022, his lawyer Denis Xhelili submitted a request to the Appeal of Vlora.

"He made a request, allegedly, I withdraw from the complaint. First he did it in his name. The court did not accept it and my signature was needed. Then 2 weeks later, there was the trial again, there was presented a letter supposedly signed by me. In February 2022, lawyer Denis Xhelili submitted the letter. In the letter it was written 'I withdraw from the case, I no longer follow the case'. They forged my signature. I was overseas at the time. "This letter has also been sent and an e-mail was allegedly sent by me in my name," says the whistleblower. According to him, there is also an audio from the Court of Appeal of Vlora and it turns out that lawyer Xhelili was present. "He denies it, but he was present at the court decision. In the audio, he answers questions from the court that I have withdrawn. The firm seems to be fake", he claims.

The whistleblower told Fiks Fare journalists that he contacted a young lawyer, Bashkim Sulstarova. "2 days before the trial, the lawyer submitted a power of attorney to the Appeal of Vlora. On February 24, 2022, it went to the session. But the session was held in the counseling room.

“Në datën 15 shkurt 2022 më dërgon klienti një prokurë që këtë çështje ta përfaqësoja unë në Gjykatën e Apelit. Shkova në Apel dhe u informova. Më thanë se seanca është lënë në datën 24 shkurt ora 09.00. Shkoj në këtë datë dhe në sallë gjej gjyqtarin dhe i them këtu-këtu. I dorëzoj edhe prokurën. Më tha avokat po problemi qëndron këtu thotë se avokati para jush ka dorëzuar një kërkesë për heqje dorë, unë s’e pranova. E kërkova nga bëtë viktima. Më ka ardhur një kërkesë nga vendi ku ai rri që ai heq dorë. Gjithashtu më dërgon edhe një kërkesë në adresën time të e-mailit. Kështu që ndodhem në këto kushte. Më thotë se kam 3 kërkesa dhe jam i detyruar të futem në Dhomë Këshillimi dhe ta pushoj këtë çështje”, tregon avokati Sulstarova.

Ai thotë se një gjë e tillë s’ka mundësi, pasi nëse do të hiqte dorë s’kishte pse ta merrte atë si avokat.

“I kërkova gjykatësit ta shtynte edhe njëherë këtë seancë sa të sqarohej mirë kjo punë sepse nuk ka bërë kërkesë viktima për heqje dorë. Gjykata më tha se e ka lënë sot (24 shkurt 2022) dhe sot do të futeshin në dhomë këshillimi dhe do të merrnin vendim. Në këto kushte s’kisha çfarë të bëja dhe u largova. Gjykata mori vendim për pushimin e çështjes në bazë të kërkesës. Vendimi u mor vetëm me kërkesat, jo se u fut gjykata në themel”, pohon avokati.

Ai shton se ka kontaktuar edhe me avokatin e mëparshëm. “Ai e mohoi kategorikisht që s’kishte qenë në seancën e datës 1 (shkurt 2022), unë kam qenë jashtë shtetit. Nuk arrij të kuptoj këtë lëmsh. Por ka audio dhe gjyqtari shprehet se i pranishëm është edhe avokati Denis Xhelili që kërkon tërheqjen” pohon Sulstarova.

Fiks Fare ka siguruar audion e seancës së datës 1 shkurt 2022. Relatori i çështjes bën apelin dhe rezulton se avokati Denis Xhelili ka qenë prezent në atë sallë. Gjyqtari kërkon kartën ID, ndërkohë që trupi gjykues thotë se avokati ka dorëzuar një kërkesë nga viktima R.M për heqje dorë nga ankimi.

“Falsifikimi është bërë nga një person që ka shumë interesa për atë çështje. Se po ta kishte bërë viktima, s’kishte pse më emëronte mua dhe u mbyll kjo çështje dhe mbaroj. Kur vetë viktima është shumë i shqetësuar për ecurinë e këtij procesi gjyqësor me këto kërkesa që s’janë as të avokatit dhe as të klientit tim”, përfundon avokati Sulstarova.

Gazetarët e Fiks Fare bisedojnë edhe me avokatin Denis Xhelili.

“Ky zotëria me sa mbaj mend ka bërë kërkesa vetë, pastaj ka mohuar. Pastaj ka bërë revokime prokurash. Pastaj s’ka paguar detyrimet. Mashtrues me pak fjalë”, thotë ai.

Journalists ask him who is a fraud, since the editors of Fiks Fare found out that he denounced an officer who was dealing drugs. The lawyer answers that "without the court giving a decision, we should remain silent". So it protects the officer's own interests and not his client's. Fiksi asks him several times who filed the request dated February 2, 2022 in the Court of Appeal of Vlora.

"Don't fall into his trap", he replies, as the journalists inform him that with this answer "are you protecting your client or the other?".

The lawyer is asked several times about that letter, but refuses to answer, claiming that "the informant blackmailed me". Fiction tells him to file a criminal complaint. "I can't express myself about things I don't know" and then hangs up the phone.

Fiksi asks the whistleblower what happened to the person, OPGJ, who accused him in January 2018.

"His name was Julian Balliu, at that time Head of Circulation in Lushnja. With the information I have, I have been appointed traffic police inspector in Morina. It has returned to the State Police", he replies, as he says that it has become a very dirty game.

"The prosecutor Deritan Gripshi and my lawyer Denis Xhelili cooperated. Maybe even some judges", he says.

In the end, he claims that he still hasn't received the debt from this officer.

"I want my money back. Nothing, not land, not fuel. I want justice", he concludes.
