The Special Prosecutor's Office has closed the investigations and sent the businessman Pëllumb Gjoka and 6 others arrested as part of the Metamorfoza operation for trial.

The Special Prosecutor's Office against Corruption and Organized Crime has completed the preliminary investigations of criminal proceedings no. 09, of 2023, and submitted on 26.04.2024, in the Special Court of First Instance for Corruption and Organized Crime, the request to send the case to trial, in charge of the following defendants:

1. The defendant Pëllumb Gjoka, accused of committing the criminal offences:
 "Premeditated murder", to the detriment of the victim Gjin Ndoj (Boriçi), finalized on 09.08.2020, in the city of Shkodra, committed in the special form of cooperation, that of the structured criminal group, "Structured criminal group" and "Commitment of criminal offenses by the structured criminal group and criminal organization", provided by articles 78/2, 28/4, 333/a/1 and 334, of the Criminal Code.
 "Providing the conditions and material means to commit murder", to the detriment of the citizen Kleant Musabelliu, carried out in the special form of cooperation, that of the structured criminal group, "Structured criminal group" and "Commitment of criminal offenses by structured criminal group and criminal organization", provided by articles 80, 28/4, 333/a/1 and 334, of the Criminal Code.
 "Providing the conditions and material means to commit murder", to the detriment of citizens Dorian Duli and Ibrahim Lici, carried out in the special form of cooperation, that of the structured criminal group, "Structured criminal group" and "Perpetration of criminal offenses by structured criminal group and criminal organization", provided by articles 80, 28/4, 333/a/2 and 334, of the Criminal Code.
 "Active corruption of the judge, prosecutor and other justice officials", carried out in cooperation, provided by articles 319 and 25, of the Criminal Code.
 "Illegal possession and production of weapons, explosive weapons and ammunition", carried out in the special form of cooperation, that of a structured criminal group, "Structured criminal group" and "Commitment of criminal offenses by a structured criminal group and organization criminal", provided by articles 278/1, 28/4, 333/a and 334, of the Criminal Code.

2. The defendant Behar Brajović, accused of committing criminal offenses:
 "Premeditated murder", to the detriment of the victim Gjin Ndoj (Boriçi), finalized on 09.08.2020, in the city of Shkodra, committed in the special form of cooperation, that of the structured criminal group, "Structured criminal group" and "Commitment of criminal offenses by the structured criminal group and criminal organization", provided by articles 78/2, 28/4, 333/a/1 and 334, of the Criminal Code.
 "Providing the conditions and material means to commit murder", to the detriment of the citizen Kleant Musabelliu, carried out in the special form of cooperation, that of the structured criminal group, "Structured criminal group" and "Commitment of criminal offenses by structured criminal group and criminal organization", provided by articles 80, 28/4, 333/a/1 and 334, of the Criminal Code.

3. Defendant Edmond Preka, accused of committing criminal offenses:
 "Premeditated murder", to the detriment of the victim Gjin Ndoj (Boriçi), finalized on 09.08.2020, in the city of Shkodra, committed in the special form of cooperation, that of the structured criminal group, "Structured criminal group" and "Commitment of criminal offenses by structured criminal group and criminal organization", provided by articles 78/2, 28/4, 333/a/2 and 334, of the Criminal Code.
 "Providing the conditions and material means to commit murder", to the detriment of the citizen Kleant Musabelliu, carried out in the special form of cooperation, that of the structured criminal group, "Structured criminal group" and "Commitment of criminal offenses by structured criminal group and criminal organization", provided by articles 80, 28/4, 333/a/2 and 334, of the Criminal Code.
 "Unauthorized production and possession of military weapons and ammunition", carried out in the special form of cooperation, that of a structured criminal group, "Structured criminal group" and "Commitment of criminal offenses by a structured criminal group and criminal organization ”, provided by articles 278/1, 28/4, 333/a/2 and 334, of the Criminal Code.

4. The defendant Astmer Bilali, accused of committing criminal offenses:
 "Providing the conditions and material means to commit murder", to the detriment of citizens Dorian Duli and Ibrahim Lici, carried out in the special form of cooperation, that of to the structured criminal group, "Structured criminal group" and "Commitment of criminal offenses by structured criminal group and criminal organization", provided by articles 80, 28/4, 333/a/2 and 334, of the Criminal Code.
5. The defendant Ardrit Hasanbegaj, accused of committing criminal offenses:
 "Providing the conditions and material means to commit murder", to the detriment of citizens Dorian Duli and Ibrahim Lici, committed in a special form of cooperation, that of to the structured criminal group, "Structured criminal group" and "Commitment of criminal offenses by structured criminal group and criminal organization", provided by articles 80, 28/4, 333/a/2 and 334, of the Criminal Code.
6. Defendant Oltian Bistri, accused of committing criminal offenses:
 "Passive corruption of persons exercising public functions", "Disclosure of acts or secret data" and "Cleaning of the proceeds of criminal offense or criminal activity", provided for from articles 259, 295/a and 287/2, of the Criminal Code.
7. The defendant Xhevahir Lita, accused of committing criminal offenses:
 "Passive corruption of judges, prosecutors and other justice officials", committed 2 (twice), and "Disclosure of secret acts or data", provided by articles 319/ç and 295/a, paragraph 2, of the Criminal Code.

In the framework of the investigations of this criminal proceeding, some immovable assets were seized as a product of the criminal offense, among others, which were attached to the acts sent for trial as follows:

1. 3 (three) immovable properties of the "Forest" type, with a total area of ​​390,000 m2, as follows:
1.1. Forest type estate, with an area of ​​113,500 m2, located in Pulaj-Plazh, Velipojë, Shkodër;
1.2. Forest type estate, with an area of ​​61,470 m2, located in Pulaj-Plazh, Velipojë, Shkodër;
1.3. Forest property, with an area of ​​215,030 m2, located in Pulaj-Plazh, Velipojë, Shkodër;

2. 5 (five) immovable property of the building type, with purchase value according to the contracts
980 300 Euro, as follows:

2.1. Construction area of ​​the apartment type, with a total area of ​​the apartment including common areas of 400 m2, with a total price of 200,000 (two hundred thousand) Euros, located in Tirana.
2.2. Construction area of ​​the apartment type, with a total area of ​​the apartment including common areas of 400 m2, with a total price of 200,000 (two hundred thousand) Euros, located in Tirana.
2.3. Shop unit, with a construction area of ​​125 m2, with a total price of 300,000 (three hundred thousand) Euros, located in Tirana.
2.4. Shop unit with a construction area of ​​95 m2, with a total price of 230,000 (two hundred and thirty thousand) Euros, located in Tirana.
2.5. Construction area of ​​the residential apartment type, with a total area of ​​110.6 m2, with a sale price of 50,300 Euros (fifty thousand three hundred) Euros, located in Tirana.

Meanwhile, for the other persons under investigation, accomplices in the commission of the above criminal offenses, for whom the security measures approved by the Special Court of First Instance for Corruption and Organized Crime have not yet been executed, for other criminal facts , as well as for other persons involved in criminal activities, which have resulted during the investigative actions carried out in this criminal proceeding, the separation of the criminal case has been decided and they are still in the phase of preliminary investigations.
