The High Prosecution Council will judge today three new appointments of prosecutors in the Special Prosecutor's Office. But the game and the elbows that have started since time have taken visible form to qualify and disqualify candidates, in violation of the law.

In December of last year, the High Prosecution Council selected among the 8 candidacies with the highest points 3 prosecutors who could go to SPAK, Anila Jella, Ndini Tavani, and Olsi Dado (this person commanded there). But in order for their appointment to become final, they must be "approved" by a commission within the SPAK consisting of two Spakists and two officers and a judge of the GJKKO. And this commission, where SPAK risks taking the powers of KLP, turning into a closed club, that selects the members who will become part of it, has changed the classification.

For transparently inexplicable reasons, he called prosecutor Ndini Tavani unfit and qualified Bledar Maksuti, who is close to Altin Duman. This is also clearly visible in the agenda document of the High Prosecution Council that Lapsi.al managed to secure (facsimile below).

So, as it appears from points 2 and 3 of the document, it seems that the decision has been taken and the KLP is meeting in violation of the constitution and the powers it gives, to notarize a decision of SPAK, which chooses what it wants.

Disqualified prosecutor Ndini Tavani filed an appeal against this decision, who was neither familiar with the facts, nor faced with them and above all was not given the right to a regular process of confronting the arguments. Lapsi.al has read the letter that the latter has sent to the High Council of Prosecution, the only body that has the right to choose SPAK prosecutors. He requests the suspension of the announced procedure and the right to be heard before a decision is made, especially since only two years ago he passed the real vetting sieve. He writes "...with the conviction that, better than me, it is the Council itself that will ensure the respect of its constitutional competence and even more, in guaranteeing its process for filling the vacancies of the Special Prosecutor's Office, I have the hope that the decision to be taken will be in accordance with the Constitution of the Republic, the law and the very expectation of the public for a transparent process.

The published draft decision not to appoint me as a special prosecutor should not be approved, while the process will have to fulfill all the guarantees mentioned above, which will ensure that the Council's decision will be taken only after the violations have been repaired".

He gives arguments as to why this should happen, that KLP cannot be usurped, and that SPAK cannot turn into an organization that chooses its own members.

If such a thing happens as it has started, we are not dealing simply with the violation of the right of a single person, nor with the violation of the KLP itself, but with the creation of a precedent of a sample that can get out of control .

If it is not the High Prosecution Council but SPAK itself that disqualifies or selects its members, then this is a further step in what the Prime Minister for other reasons labeled as the danger of the republic of prosecutors./ Lapsi.al
