Ilir Beqaj from the cell: I received three different decisions for the same request, justice became a trilemma

Through his lawyer, former Minister of Health Ilir Beqaj has made a public statement regarding the way his request to follow the criminal process in the courtroom, next to his lawyer and not in the "glass cage" is being handled.

In response, Beqaj emphasizes that within a short period of time, three different decisions have been made on the same request by three different judicial bodies, describing the situation as contradictory and ununified.

According to him, one panel of judges ordered him to be brought into the courtroom by the escort squad, another requested an assessment of his dangerousness from the Prison Directorate, while a third panel on appeal rejected the request.

He emphasizes that, although the independence of the judiciary is a fundamental principle, in this case, according to him, different decision-making on the same issue creates confusion and lack of clarity in practice. Beqaj also mentions a letter from the Albanian Helsinki Committee addressed to justice institutions and the Ministry of Justice, regarding the handling of similar requests for several persons in criminal proceedings.

In conclusion, he states that in the next session he will request that his lawyer also remain within the shared security environment during the trial, describing the current situation as unclear and unusual in judicial practice.

In the capacity of Mr. Ilir Beqaj's lawyer and at his request, below is his public statement:

The dilemma that became a trilemma
Last Sunday I communicated with you regarding a contradictory position of two different GJKKO bodies regarding my request to follow the criminal process against me in the courtroom, next to my lawyer, and not in the glass cage.
But on Friday, June 5, 2026, the same request, presented before a GJKKO Appeals body, received a negative response, even different from the two previous decisions.
Thus, on June 5, the dilemma of how to follow the criminal processes against me became a trilemma.
For me, as the same person, for the same request, three different decisions were made:
* a trial body, composed of three judges, ordered the escort platoon to bring me to the courtroom;
* another trial body, with one judge, asked the General Directorate of Prisons to assess the dangerousness in the specific case;
* a third panel, with a judge on appeal, has dismissed the request.
Three different decisions from three different trial panels are not, in themselves, something surprising. Each trial panel is independent in its decision-making. This is an achievement of independent justice.
Only, in this case, we do not simply have independent justice. We have perverted justice.
Meanwhile, on June 4, 2026, the Albanian Helsinki Committee wrote to the following, regarding my request to remain in the courtroom, as well as similar requests by Messrs. Ilir Meta and Erion Veliaj:
* Mr. Erjon Bani, President of the GJKKO;
* Mr. Ilir Rusi, President of the KLGJ;
* Mr. Toni Gogu, Minister of Justice.

Faced with the trilemma created by the independent judiciary, in the very first upcoming hearing, all that remains is for my lawyer to ask the court to allow him to stay with me inside the glass cage during the hearing.
