The GJKKO passed the file for trial, Veliaj requests the Constitutional Court to annul the decision

The Mayor of Tirana, Erion Veliaj, has requested the Constitutional Court to invalidate the February 9 decision of the GJKKO that passed the file in his charge for trial, as well as the invalidity of all actions carried out on the basis of this decision.

Dear media representatives,

In continuation of our practice of informing the public opinion on any legal action taken by Mr. Veliaj's defense, we inform you that today we have filed with the Constitutional Court the request for the annulment of decision no. 29, dated 09.02.2026, of the Special Court of First Instance for Corruption and Organized Crime, as well as for the invalidity of all actions taken on the basis of this decision.

Our request also includes declaring as unconstitutional two legal provisions that have directly contributed to the violation of the constitutional rights of Mr. Veliaj, as well as of every citizen of the Republic of Albania, who is in the same conditions.

The gist is clear:

This process has been conducted in serious violation of fundamental rights. Mr. Veliaj and his defense have been denied real time to analyze a file with tens of thousands of pages, reducing the defense to a formality; The principle of equality of arms has been violated, as the prosecution has acted with full procedural advantage; The trial has been conducted in conditions that violate the independence and impartiality of the court; Mr. Veliaj has been treated in a manner that violates the presumption of innocence and human dignity, including being held in solitary confinement during hearings where he should defend himself freely.

Under these conditions, the decision to send the case to court was made on the basis of a fundamentally compromised process, producing an unconstitutional and, consequently, invalid process, which cannot produce valid legal consequences.

For these reasons, we have requested the Constitutional Court:

to annul the decision of the preliminary hearing;
to declare invalid the actions carried out on its basis;
to declare as incompatible with the Constitution Article 14 of Law No. 95/2016;
to declare as incompatible with the Constitution Article 332/gj of the Code of Criminal Procedure.
This is not simply an individual issue. It is a challenge to restore the constitutional order and is directly related to the way justice functions in this country. We will use every legal means to guarantee that the Constitution and European standards do not remain declarative on paper, but are implemented in reality, just as the sovereign – the Albanian people – have expressed their will through the adoption of the Constitution.
