Patsy's Italian restaurant, a midtown business that operates from 1944 that was once visited by Frank Sinatra, has faced two lawsuits, one accusing owners and management of harassment, belittle, insult and abuse of staff, and a second-class lawsuit charging the restaurant with changing the timing and fees records, As well as stealing tips.
The plaintiff's lawyer Maimon Kirschenbaum told the Eater newspaper, "This particular case goes well beyond the norm."
The plaintiffs in the discrimination complaint filed yesterday, September 16, are Albanians from Kosovo, Kreshnik Hoti, who was on staff since 2018, and Desiart Ymeraga, who has been working at the restaurant since 2017. They claim patsy's co-owners Sal Scognamillo and his heavy hatred of Albanians has created a hostile working environment. The duo seek a jury trial on their files, which also allege discriminatory conduct by Scognamillo's son, co-owner and manager Joseph, and wife Lisa, co-owner and lawyer of the restaurant.
The lawsuit over "restaurant hate," comes after conflict with the other famous New York restaurant of the same name that the owners believe "has affected their name and likeness" according to the filings. Another Patsy's, Patsy's Pizzeria, founded in East Harlem in 1933, was sold to The Albanian Frank Brija, in 1991, by the widow of the founder, Pasquale "Patsy" Lanceri. In 1995, Brija had registered the name and in 1995 opened a Patsy Pizzeria franchise with partners, starting with a location on 3rd Avenue, near now closed 34th Street.
According to the lawsuit filed yesterday, in 2017 and 2018, associates of Patsy's Italian Restaurant told the plaintiffs when they were hired not to tell the owners of Patsy's Restaurant that they were Albanians because they "hate Albanians." Apparently, when the owners learned of their ethnicity, Scognamillo assigned the plaintiffs heavy tasks "which other non-Albanian waiters were not obliged to do.". Scognamillo is also alleged to have harassed Hoti and Ymraga, saying "all Albanians deserve a bullet" and "deserve to their relatives," calling them "stupid" and "gay," according to the indictment. The indictment says Scognamillo allegedly also "told employees to taunt and harass" Albanians. Hoti and Ymeraga said the environment caused emotional distress, prompting them to leave eventually.
The lawsuit alleges that Scognamillo and Patsy's Italian restaurant violated the plaintiffs' civil rights and freedoms by discriminating against them because of their ethnicity. They are seeking a refund for damages, payment of attorney's fees and a judgment by the jury.
The additional complaint of the group filed by Hoti and Ymeraga in relation to alleged violations of wages and hours at the restaurant, reads: "At its peak, Patsy's Italian restaurant may have been a favourite placement for the legendary Frank Sinatra, but in its current form the restaurant is just like any over-priced Italian restaurant in a city full of expensive Italian restaurants, except for the fact Patsy's restaurant also steals tips from its employees, illegally pays them and changes their time and salary records to cover it."
