Berisha: Irena with 5 surnames should no longer be a judge
Sali Berisha

The leader of the Democratic Party, Sali Berisha, in his statement after leaving SPAK stated that " this is the state of Irena (Gjoka) with 5 surnames who continues in office in flagrant violation of the Constitution and the laws of the country ."

Berisha emphasized that "a request was made to the Supreme Court of Justice to determine the end of Irena Gjoka's mandate because when she took office she did not have the criteria set out in the law to be a judge as she had a criminal decision that had become final."

"Specifically, the Constitution, in Article 6/1, provides that a person whose public integrity has been violated cannot continue to hold functions in constitutional bodies. The article states that the election, appointment or exercise of a public function in one of the bodies provided for in this Constitution, or established by law, is prohibited, regardless of the provisions made in other provisions.

"If circumstances are verified that violate the public integrity of the public official, according to the conditions approved by law, approved by three-fifths of all members of the Assembly. This is the definition of the Constitution, the law approved by three-fifths in 2016, Law 96 of 2016, provides in Article 28/D on the status of judges and prosecutors that a citizen who has been convicted of a final criminal decision, in this specific case, Irena Gjoka, cannot have the status of magistrate," Berisha said.

"This same law provides in Article 66/3, the obligation of every magistrate to immediately notify the Supreme Court of Kosovo of the existence of a condition that leads to the termination of the mandate. This same law provides that the judges of the Serious Crimes Court, where Judge Irena Gjoka was, would continue to remain in their position, except in the case where there were reasons for the termination of the magistrate's status.

"Do you understand, my friends, that this delinquent who is hiding from Altin Troplini, from the prosecutor general, from the chief inspector general who says they did not notify us, but it seems that his employees have hidden the documents from her, is standing in office, trampling on the country's Constitution, trampling on the laws with three-fifths, which dictate her immediate removal," Berisha added.

The democratic leader further emphasized that "according to the decriminalization law, approved by three-fifths, concealment, refusal to declare convictions, even if not final - Irena with 5 surnames has a final one - causes the immediate termination of the judge's function and Irena Gjoka has not declared a trial, a conviction and two deportations, but is protected in an unconstitutional, illegal manner by a criminal accomplice called Altin Troplini."

"And not only him, he is protected by the Supreme Court, he is protected by the Prosecutor General, even though everything accuses this criminal of concealing her criminal acts. According to Law 95 of 2016, the law on special structures, the court, the prosecutor, the BKH, all those who had to work in these structures, had to declare whether they had final or not convictions inside or outside the country for any kind of legal violation.

And Irena with 5 surnames has again not declared her conviction in Greece. Refusal to declare constitutes grounds for her immediate dismissal. So, according to the three laws approved by three-fifths, Irena Gjoka should not have been a magistrate at least since the entry into force of the decriminalization law.

The facts were first made public by Greek newspapers and then by official documents with an apostille stamp brought and submitted to the competent Albanian bodies in February 2024. But when the facts were made public, when the documents were submitted to the official Albanian institutions, the latter had the obligation to decide for themselves on the conclusion of the end of the mandate for Irena Gjoka from the moment the law prohibits her from being a judge and her criminal prosecution.

"But, she is protected by Altin Troplini against a fat bribe or an illegal order. However, Altin Troplini becomes a co-author in an ugly crime where the Constitution and the laws of the country are violated," Berisha said.
