Veliaj's lawyer speaks to Top News: If the Constitutional Court rejects the request for his release, we will send him to Strasbourg

Tirana Mayor Erion Veliaj's lawyer, Plarent Ndreca, has stated that the Constitutional Court should accept his request to change the security measure.

In a direct link to Top News, Ndreca stated that in this way, the Constitutional Court gives effect to its previous decision to reinstate Mayor Veliaj to office.

"We very much hope that not only for this case, but for every case, even beyond the individual case, we as a country should stop the processes within our system in order to show institutional maturity and maturity of the judicial process."

In the case of Mr. Veliaj, we hope a lot and we must, just as in the first case, the Constitutional Court showed its institutional maturity and intervention for the return of Mr. Veliaj to office, I think that in this case too, the Constitutional Court must give effectiveness to its decision. Because on the one hand it says that you have to go to office, and on the other hand it makes no sense for this same court to say that no, you can stay behind bars", said Ndreca.

Ndreca stressed that it would be absurd if the Constitutional Court rejected Veliaj's request to leave the cell, however, he stressed that if this happens, they will send the case to Strasbourg, in accordance with the rules of the European Convention on Human Rights.

"It would be absurd and an indication of institutional immaturity that I think will not happen in this case. And I appreciate that the Constitutional Court will show its institutional maturity. I even think that unfortunately, we have gone as far as the Constitutional Court, because I think that the lower courts should have shown the same constitutional maturity so that we would not go so far."

However, even if it happens that the Constitutional Court will not consider the request, which in our judgment is untenable from a constitutional point of view, we will immediately go to Strasbourg, using every speedy channel that the European Convention on Human Rights allows us, to consider our request as soon as possible," he declared.

The decision on Mayor Erion Veliaj's request will be given in the next session. This is the second time that Veliaj has addressed the Constitutional Court, which in January of this year confirmed him in office as mayor of Tirana.
