Manjani: The justice reform has failed in purpose and objective
Ylli Manjani

The former Minister of Justice, Ylli Manjani, through a message on 'Facebook', emphasizes that he stands by the idea of the failure of the justice system.

According to him, the justice reform has failed in purpose and objective.

" Do you remember where they said that after the reform, investments will increase?!
Where are they? After the reform, the climate for doing business has worsened. Towers and buildings have been built, but less and less business is done in them ," writes Manjani.

Ylli Manjan's post

I stand by the idea of FAILURE of the system.
*******
Concentrating all striking energies on Altin Duman or other SPAK prosecutors is wrong.
What should be struck as FAILED is the justice reform. The reform has failed in purpose and objective. It has failed to establish a culture of fair and equal rule of law for all.
The reform has failed to fight corruption. The latter only deepened. In terms of percentage, today corruption has come close to the theft of all public money. So there are no more tips, because they take all the funds themselves and give them to their own companies!
Corruption today does not leave the road with thin asphalt, without lines or protective devices, but leaves the country without a road at all. Did you see Erseka's road?
The reform in justice is what has failed.
Do you remember where they said that after the reform, investments will increase?!
Where are?
After the reform, the business climate has worsened. Towers and buildings have been built, but less and less business is done in them. See how many lights are lit in them...
After the reform, the Albanians fled. We have only 1.5 million of the 4.3 million citizens left. What justice is this that drives people from their country?!
Do you want more proof of failure?!
See the paralysis of the public administration, which, despite being political, does not move anything for fear of unjust imprisonment.
After the reform, justice works only with the culture of punishment. With or without proof, with or without law, culture is captured and brought inside. Prison-prison-prison and prisons full of innocents. Of course with selection, not just how to get money.
So failure gone failure!
And the failure is politics, not Duman's or the prosecutors there. Because Dumani, who came after Kraja, is gone, what's the difference?!
Nothing!
Therefore, the problem must be seen in the eyes. Failure must be accepted. We need to analyze well where we went wrong. Then we can give justice another real chance.
It should definitely start from creating a clear and unambiguous legal basis. Totally different from today. The court, especially the High Court, which has put on the communist scarf of the pioneer, must be put on the constitutional tracks!!!
In any case, justice cannot come above the Constitution, the law and respect for freedom and rights.
There is no justice when the judge is forced by law to pledge his dignity, privacy, himself and his family to the prosecutor, who is only one party in the courtroom after all.
And so on, that the case is not similar to the case, but the common thing is that inquisitorial justice has been established in the name of punishment.
This is unacceptable for a democratic society!
That's why I say that the problem should be seen in the system and not in the people, who in such a system abuse easily and even with public consent!!!
Constitutional and legal justice is not, never has been, popular justice. The latter was prompted by the reform...
