"Dear Madam Speaker of the Assembly", this is how the letter of the Socialists addressed to the Speaker of the Parliament Lindita Nikolla starts, where they inform her about the candidacy of Bajram Begaj for the new head of state, but what is noticed is that one of the senders of this letter is Mrs. Nikolla.
Her signature is the third in a row in the Socialist letter and it's that Lindita Nikolla addresses herself. Regarding this detail, there has been a reaction from the Institute of Political Studies, which directs criticism towards the Speaker of Parliament Lindita Nikolla.
According to the ISP, a political and institutional person can not address a request to himself, especially in such an act of constitutional value and reference to historical and institutional memory, so this ethical and protocol paradox could / should have been avoided.
The ISP also adds that signatures by MPs who are direct / indirect part of the non grata lists or penalties recognized by the strategic partners, the US and the EU, were also avoided. It is not known who he is referring to with this ISP, but probably the firm of Ornaldo Rakipi, the son of Aqif Rakipi.
Full response:
The Assembly is electing the President of the Republic. This is an act of constitutional and political importance for Albania. The ISP is monitoring the Assembly and election practices are an essential component of monitoring and evaluation. In this case, the political will is clear, but the constitutional process also requires solemnity in content and in procedural terms.
Looking at the initiating parliamentary document, it turns out that the constitutional act of collecting signatures addressed to the Speaker of the Assembly Lindita Nikolla, although it starts with the standard expression "honorable lady speaker of the Assembly" continues with the signatures, where "honorable lady speaker of the Assembly" is a firm of third! The majority has the necessary signatures, decision-making is already a procedure, so it simply has the luxury of choosing which deputies would formally sign the act. A political and institutional person can not address a claim to himself, especially in such an act of constitutional value and reference to historical and institutional memory, so this ethical and protocol paradox could / should have been avoided. To go even further, the same could be said about the need for quality selection,
Lawyers advising practice in such cases, group and Assembly counselors drafting documents, and politicians still in the know about the state and good institutional practices will need to advise their superiors and avoid such documents, considering for the solemnity and seriousness of the process, decision-making and constitutional act of historical value.
