The European Commission reacts to Top News about Rama's intervention in the Criminal Procedure Code to "protect" ministers

The European Commission, in a reaction to Top News, has commented on the Albanian government's proposal to amend the Criminal Procedure Code to remove the right of courts to issue suspension decisions against the Prime Minister, ministers, the President, the Ombudsman and the head of the Supreme Audit Institution.

According to the EC, any legal initiative related to the judiciary must be in line with European standards and the European Union acquis, respecting the independence, accountability and efficiency of the judicial system.

“The EU is closely following the amendment to the Criminal Procedure Code submitted on February 16.

The EU monitors and assesses any legislative initiatives related to the judiciary in all candidate countries, including Albania. These initiatives are expected to be in line with the EU acquis and European standards.

This also includes the implementation of the 2016 justice reform in the context of Albania's EU accession negotiations. The rule of law and the independence, accountability and efficiency of the judicial system in Albania are fundamental elements of the EU enlargement process.

Rhetoric that sows public distrust in the judiciary and in the independence, impartiality, and integrity of the judicial and prosecutorial systems is unproductive.

"As previously stated, it is the responsibility of the Albanian Parliament to deal without delay with requests for lifting the immunity of its members. The effective fight against corruption is of essential importance for Albania's progress towards EU membership ," the European Commission said in a statement to Top News.

Prime Minister Edi Rama on Monday formalized a legal initiative to strengthen the immunity of his government cabinet and several other senior officials as a response to the suspension from office of the government's number 2, Belinda Balluku.

At a meeting of the Socialist Party parliamentary group, led by Prime Minister Rama, the Socialists announced that they would amend Article 242 of the Criminal Procedure Code, removing the right of the courts to issue suspension decisions against the Prime Minister, ministers, the President, the Ombudsman and the head of the Supreme Audit Office.
