The Speaker of the Assembly, Lindita Nikolla, clarified the role of the Assembly in relation to the institutions of new justice, rejecting the claims that the majority wants to control SPAK.
In an interview given to the director of Information of Top Channel, Robert Rakipllari, Nikola called on the opposition and the majority to reflect after 3 months of blocking the parliamentary sessions. She said that the opposition has a chance to restore the demands for investigative commissions after the entry into force of the new law.
The head of parliament also underlined that the Parliament is not in crisis and that all this anomaly created in the plenary sessions by the democratic deputies has come as a result of the impasse in which the Democratic Party is.

Rakipllari: Lady Speaker of the Parliament! The Albanian parliament since the beginning of October 2023 and until now continues in a prolonged crisis, let's say, one of the most serious of these 33 years. So the parliamentary sessions do not take place, there are whistles, noisemakers, exceptions, etc. Why did this crisis happen in your opinion and that it continues?
Nikolla: I would like to say that it has not turned into a parliamentary crisis, because a parliamentary crisis would mean that the Assembly of Albania does not function and does not exercise its constitutional duty to make decisions, we are not in these conditions. We are definitely in a situation where the normality, the development of the parliamentary sessions is not in accordance with the regulation of the Assembly, where the members of the opposition violate the regulation and the Code of Ethics. And where, let's say healthy political debate for the adoption of draft laws is excluded. Let me tell you that since the start of this legislature and until the moment we speak, there has been a deep crisis in the Democratic Party - since September 2021, which is being outlined and is trying to be posed as a parliamentary crisis. It is an internal crisis of the Democratic Party. The opposition has every right to use every democratic and constitutional means to exercise its functions, but in no way to bring the street to Parliament, or the alley to Parliament, or to block the work of other deputies who do not think the same as them. So even as far as the most serious crisis is concerned. The Parliament has also recognized crises in the Parliament. A serious crisis has also been the vacating of mandates in the bloc to the entire opposition. I do not believe that we are in an institutional crisis, but it is still a moment where each of us requires calmness, patience, and prudence to overcome. But above all, it requires courage from the opposition to overcome itself or for the interests of a person and to live up to the expectations of the opposition people who voted for them to be in Parliament, to speak about laws, to speak about problems and concerns of citizens.
Rakipllari: The crisis within the opposition is clear because of the representation of the parties that demand it, but why do you as Parliament and you as the leader of the Parliament leave this thing in abeyance and do not make a decision to determine to whom the head of the group belongs parliamentary or all the institutions that depend on the Assembly?
Nikola: I understood you, I have not left anything pending. In this position, I am the first among equals, I am not even a leader of a political formation, and as such I have no right to decide more than who is the chairman of the parliamentary group of a political party. It is the prerogative of the political parties with their internal rules to set the parliamentary conditions, such as parliamentary group elections, who will be their political leader. And definitely the self-declaration of every deputy in the Parliament of Albania. So that in this sense of both the regulation of the Assembly and the constitution, the ball is not in the court of the President of the Assembly. The ball is in the court of the democratic party, they are in conflict. They have addressed the court. They have to resolve this deadlock with their internal rules and then the President of the Assembly has the obligation to notify the Assembly and all other structures.
Nikolla: Undoubtedly... So far, I have tried my best both in the hall and outside the hall to offer prudence, communication, to offer citizenship and ethics. And...I did not respond in the same currency as it usually happens in plenary sessions, labels to...and insults to the Speaker of the Assembly. I made all the efforts with meetings... the door of the Speaker of the Assembly is an open door for all political groups, for every individual member of parliament. And in this perspective, everyone should definitely make efforts, but the rules of the Assembly cannot be passed easily. When we have those sad scenes in the Parliament of Albania, where fire is set, flares, whistles, insults and so on, definitely in these conditions the rules of the Assembly will act as it did with the rising... at the request of a group of deputies and with the decision-making of the committee's secretariat for procedures, regulation and ethics.
Rakipllari: Do you see a solution or will the parliament continue to have this anomaly that you are calling?
Nikolla: I believe there will definitely be a moment of reflection by the opposition to understand that this is not the solution. This path they have followed has not led them anywhere
Rakipllari: Do you expect a reflection from the majority?
Nikolla: The majority definitely requires reflection for all parties, but the majority has...said its objections and has done its duties as far as the arguments given to the investigative commissions are concerned, and in the future it is on top of the task to learn the functioning of the parliamentary committees and the session...however, there is room for everyone to reflect.
Rakipllari: The parliament or the SP parliamentary group has taken an initiative to give the assembly a new monitoring or controlling role, as you consider it, in relation to independent institutions. And the institutions of new justice are included here. What is the truth here and where does it consist?
Nikolla: I could say that... all this is a story made up in the media. There is no truth to the change in the role of the assembly from...that originates from any communication within the parliament. The role of parliament, this...this discussion; the constitution concluded by establishing the role of the Parliament in a parliamentary republic as the most important institution where the will of the people that represents and sovereignty is directly developed and in this perspective it is undoubtedly Article 80 of the Constitution of the Assembly point 3, where the institutions of others have the obligation to inform and report on certain issues when requested in the Assembly. And all this interaction operates in accordance with the principle expressed in Article 7 of the constitution "check and balance", so there is neither nor can there be a nosebleed, I would say this in the internal affairs of institutions independent from the assembly of Albania.
