The Socialist Party's proposal to establish a Special Parliamentary Commission for Administrative-Territorial Reform has been revealed.

Based on the approved decision, the commission will have as its objective the review of the legal and institutional framework of local government, the analysis of the existing territorial structure, local finances, access to public services and the alignment of these processes with EU standards and regional cohesion policies.

The Commission will consist of 17 members, representatives of all parliamentary forces: 9 MPs from the Socialist Party, 6 from the Democratic Party, 1 from the Alliance for Change, 1 from the Freedom Party.

The chairman of the committee will be from the parliamentary majority, while the deputy chairman will represent the opposition.

Objectives of the commission:

The Commission will:

-Analyze the functionality of the current territorial division,

-Propose options for a new redesign of the administrative map,

-Suggest measures for the financial soundness of local units,

-Ensure comprehensive consultation with the community, civil society, public institutions, academia and international partners,

-Draft an analytical document with recommendations and legal proposals for the reform.

The Commission will work for a 9-month period, with the possibility of extension if necessary, and will be supported by a group of local and international experts, selected from various institutions.

International organizations such as the EU, OSCE, and the Council of Europe are also expected to be involved in the process, to provide technical expertise and assistance in this important reform for the democratic and efficient functioning of local government.

DRAFT DECISION

ON THE ESTABLISHMENT OF THE SPECIAL COMMISSION FOR ADMINISTRATIVE-TERRITORIAL REFORM IN THE REPUBLIC OF ALBANIA

In accordance with Articles 77, paragraph 1, and 78, paragraph 1, of the Constitution and Articles 24 and 55, paragraph 1, of the Rules of Procedure of the Assembly, upon the proposal of a group of deputies,

OF THE REPUBLIC OF ALBANIA

DECIDED:

The establishment of the Special Parliamentary Committee for the Administrative-Territorial Reform in the Republic of Albania.
The Special Committee has as its object of activity:
a) to review the legal and institutional framework of local government;
b) to analyze and propose options for territorial redesign and strengthening the administrative capacities of local government units;
c) to analyze the current system of local finances and recommend measures for the financial soundness and increased sustainability of local self-government units, including strengthening fiscal decentralization, increasing local revenues, optimizing expenditures and improving financial management;
ç) to review the quality and accessibility of local public services;

d) ensure the compatibility of the proposals with the acquis of the European Union and regional cohesion policies;
dh) conduct a comprehensive, inclusive and transparent consultation process with local government units, their associations, civil society and international partners;
e) submit to the Assembly an analytical document with recommendations for further steps and draft legal proposals.
III. The Special Committee is composed of 17 members, of whom 9 are representatives of the Parliamentary Group of the Socialist Party and 6 representatives of the Parliamentary Group of the Democratic Party, 1 representative of the Parliamentary Group of the Alliance for Change and 1 representative of the Parliamentary Group of the Freedom Party. The names of its members will be determined by decision of the Assembly.

The Chairman of the Committee is a representative of the parliamentary majority and the Deputy Chairman is a representative of the parliamentary minority.
The Special Committee shall carry out its activities within a period of 9 months from the date of adoption of this decision. If necessary, upon a reasoned request of its Chairman, the Assembly shall decide to extend the term of the Committee's activities.
A group of local and international experts shall be established and shall operate under the Special Committee with representatives proposed by central government and local self-government institutions, local self-government associations, independent institutions and executive law enforcement agencies, public administration, academia, public and non-public universities, civil society and media institutes and organizations, as well as business organizations, etc., which shall be supported by the Technical Secretariat. The number, terms of work and specific tasks of the group of experts shall be determined by a decision of the Committee.
VII. The Special Commission, in its activity, will hold consultations and discussion sessions with the Minister of State for Local Affairs, the Minister of Finance, the Minister of State for Relations with Parliament, and the Chief Negotiator, as well as with representatives of local government and elected local associations.

VIII. Any other parliamentary party, which is not included in this committee, has the right to make proposals.

The Special Commission, in order to achieve its objective as defined above, in cooperation with the group of experts, will organize:
Hearings for the purpose of consultation, working tables and public discussions regarding the topics of work of this commission with:
central government institutions and local government itself according to the respective areas of responsibility;
justice system institutions;
independent constitutional institutions and public institutions established by the Assembly;
executive law enforcement agencies, whose scope of activity is issues that affect the interests of local government, in accordance with the relevant legislation;
well-known experts in the relevant fields;
representatives of civil society organizations and interest groups;
professors and students;
representatives of specialized organizations inside and outside the country, etc.;
Collection and processing of necessary information and data from various state structures in order to fulfill its objective;
Involvement of public opinion in this process, and especially of national minorities and their representatives.
The Presence of the European Union, the Council of Europe, the OSCE Presence in Albania, as well as other international organizations with experience in local government issues, are invited to attend, provide assistance and technical expertise in the work of the Commission and the expert group established under it.
The meetings of the Commission are valid when more than half of its members participate in them. The Commission aims to reach decision-making by consensus on all issues it examines. In the absence of consensus, decisions are taken by a majority vote of all members of the Commission.
The Bureau of the Assembly and the Secretary General are charged with creating working conditions, financial and logistical support for the activities of this Special Commission, the expert group and the technical secretariat.
XII. This decision shall enter into force immediately.
