Lawyer Plarent Ndreca has denounced the obstruction of meetings with his client, the mayor of Tirana, who is in custody in Fier prison.
Through a letter addressed to the director of this institution, Ndreca claims that this is the second time he has been denied entry to the prison to meet his client, describing this action as a violation of his defense rights.
Due to the repetition of the situation, Ndreca warns that he will contact the judicial police officer on duty to file a criminal report against the responsible employees.
Ndreca asks the prison director to intervene immediately to guarantee the implementation of the law, emphasizing that respecting it is an obligation and not a matter of the will or discretion of the institution's employees.
Letter of Ndreca:
"Director,
This is the second time the same situation has happened. Even today, I am being prevented from entering the institution and meeting with my client.
I remind you once again that Article 51 of the law expressly provides for the right of a lawyer to meet with his client at any time.
Obstructing the exercise of my duty as a defense attorney directly violates my client's constitutional rights and brings criminal liability for the persons responsible, including the offense of abuse of office.
I did not come here to escalate the situation, to make it public or to turn it into a criminal case. I came only to exercise my duty as a lawyer. But the repetition of this obstacle is forcing me to take legal action.
I ask you to intervene immediately and guarantee the implementation of the law!
Otherwise, I will be forced to contact the judicial police officer on duty to file a criminal complaint for abuse of office against all employees responsible for obstructing the exercise of my duty.
Respecting the law is not a matter of the will or discretion of the institution's employees. It is an obligation !
