
James Rubin, the former senior American official, continued today with his testimony at the Hague Special Court where the former leaders of the Kosovo Liberation Army are being tried.
After being questioned by prosecutors in the case, Rubin criticized "Special" by saying "this is not justice."
“The fact that the defendants have been in prison, in detention for more than five years, the fact that they surrendered voluntarily and the fact that they have been held here for so long concerns me. I think it has to do with politics and the rule of law. I am concerned about the fact that someone has been detained for five years before being prosecuted for a case. These people surrendered voluntarily and have been cooperating with the court. I do not understand why they had to stay in prison for five years. I do not see this as the rule of law or the rule of law that I hoped would be created by the international system. Albright did not have this kind of justice in mind when she initiated the creation of the former Hague Tribunal against Yugoslavia or the Hague tribunal. So to me this simply seemed like collective guilt because the defendant was a leader of the KLA. Given that I have seen the leaders of the KLA up close in the mountains and I think that no other person outside the KLA "Having had this opportunity, having a good idea of ??the functioning of the KLA, I saw for three days how they behaved, who was responsible, who was the commander, who was the supporter. Having this kind of knowledge and knowing how the developments were, I think this was wrong, this is not justice. I am not a lawyer by profession, but I have the right to express and say my opinion out loud," said James Rubin.
Rubin stated that after communicating with international experts in the field, he has come to the conclusion that the way Hashim Thaçi has been treated is unusual.
"I spent time thinking, preparing. I thought from year to year that the trial would open today, and the trial would open tomorrow while the years passed and nothing happened for many years. I wondered why it took five years to create such a case while the indictment was filed five years ago. I didn't understand all this. I asked people in this field, I told them if this was normal. I spoke to international lawyers and lawyers with international reputations who told me that this is an unusual thing to treat a statesman who has voluntarily surrendered himself and to the jurisdiction of a court that he himself created when he was prime minister to show European leaders that he wanted the country to become part of the EU," he said.
Rubin emphasized the day before that former President Hashim Thaçi had no decision-making power in the KLA and that, according to him, he had merely a political role. The senior American official said that for military decisions, Thaçi had to take instructions from the movement's commanders.
Since November 4 and 5, 2020, Hashim Thaçi, Jakup Krasniqi, Kadri Veseli, and Rexhep Selimi have been in custody in The Hague, where the Kosovo Specialist Chambers are located. Their trial is set to begin in April 2023.
According to the indictment, Thaçi, Veseli, Selimi and Krasniqi are accused of crimes against humanity and war crimes, including the murder of more than 100 victims as well as the unlawful detention and torture of hundreds of victims.
