The chilling details of Marigona Osmani's murder: She was shot with a phone

With a phone charger and a stick, the deceased Marigona Osmani was beaten for almost 48 hours by Dardan Krivaqa and Arbë Sejdiu, who were found guilty of her murder.

19 pages more than the first judgment, it is the second sentencing judgment against Dardan Krivaqa and Arbë Sejdi, declared guilty for the murder of Marigona Osmani.

About two months after the announcement of the verdict, the president of the trial body compiled the complete decision, with which he sentenced Dardan Krivaqa to life imprisonment and Arbër Sejdiu to 15 years.

In the reasoning of the court of Ferizaj, it is stated that Krivaqa deliberately and cruelly beat the 18-year-old woman with whom he was living to death.

"As for the accused DK, from the evidence administered, the court has established beyond a reasonable doubt that all the objective and subjective elements of the criminal offense of aggravated murder from Article 173 par.1 subpar.1.4 of the KPRK are present in his actions. as in the time, place and manner described as in the provision of this judgment, in which case the accused deliberately, cruelly hitting him with a telephone charging cable and a black stick deprived him of the life of the now deceased MO, with whom he was cohabiting, where her death was slow, as a result of the use of physical force in a gradual manner, from time to time for a period of time of at least 48 hours, giving caused great physical and mental pain. That the accused DK has exerted particularly severe-extremely severe violence against the deceased MO, is also proven by the autopsy report no.ref.MA21-... dated 23.08.2021 compiled by the forensic expert Prof. Dr. NH, in which report are described in detail all the multiple bodily injuries caused and the cause of her death."

The Court of Appeal had returned this case to a retrial, on the grounds that the cruelty of this murder had not been sufficiently proven, while the second judgment mentions the steps taken by the judge in this regard.

"Therefore, from all this that has been ascertained by the forensic expert, as in the autopsy report, in which all the bodily injuries that the accused caused to the deceased were recorded in detail, and which injuries were multiple injuries called in the medical language as polytrauma, and which injuries were clarified and confirmed by the forensic expert even in the judicial examination, where from these multiple injuries inflicted permanently and gradually, the expert concluded that the victim had having experienced particularly severe pain and suffering, the jury assesses that in this case cruelty is indisputable."

This time, the Court in Ferizaj did not find any extenuating circumstances for Dardan Krivaq, when it decided to impose capital punishment, while there were many aggravating circumstances.

"The way and the circumstances in which the criminal offense was committed, - in the most barbaric way with the gradual deprivation of life in a closed environment in the apartment, where the deceased was completely unprotected. The accused has been previously convicted with numerous final judgments for criminal offenses of various natures, therefore, all these actions of the accused in their unity show the high degree of participation and the high degree of will in the commission of the criminal offense, where serious consequences have been caused by this criminal offense in the family of the deceased and great concern has also been caused to the citizens of the Republic of Kosovo.

Krivaqa was found guilty twice for the criminal offense of aggravated murder, and Arbë Sejdiu for assisting in the commission of the criminal offense of aggravated murder.
