
The case against Florian Sulejmani has been nothing more than a "soap bubble", which the people of the new justice in Berat have abused in the worst possible way. As VoxNews warned, the Tirana Court has lifted the suspension from duty of the head of the AMP, writing that "he was suspended in violation of the law ". Initially, the suspension was left in force in Berat during the reassessment of the security measure, but the file was transferred to Tirana.
A decision that should have been made even before the suspension, since the office of the director of the AMP is located in Tirana and not in Berat! Moreover, he is the head of an institution that operates under a special law, approved by the Albanian Parliament, and consequently the case should have gone to SPAK. The Prosecution and Court of Berat realized that they had demonized him, and in order to cover up what is not said, they took him to the Prosecution and Court of Tirana, as a precautionary measure.
But what happens now?
Berat's actions resemble a "conspiracy", with many interests all around. With people who, in revenge for Sulejman's decisions, acted insidiously, suspending him in a peripheral justice system. But now that the Tirana Court has acted and decided, where will they "hide?!
Normally, the investigation of justice officials is carried out by the Special Prosecution, which may now act not for Sulejmani, but for the justice circles in Berat, who act for very narrow and personal interests. But when justice turns personal or for revenge, we are dealing with a multitude of violations and criminal offenses.
At a hearing held a few days ago in Tirana, the representative of the prosecution body said that "the official's previous actions had not brought direct consequences to the functioning of the institution." Naturally, they had not, since Sulejmani had only implemented the law on the AMP, which states that he can also undertake transfers.
During the closed-door session, the prosecutor stated that there are no criteria for the suspension measure to remain in force. Because, according to the prosecutor, the order of the head of the AMP to transfer two officers, one to Dibër and the other to Fier, did not cause any consequences, as they could have been replaced with other officers.
The decision of the Prosecutor's Office and the Court of Tirana to lift the suspension was very late, but fair! In fact, it was in unison with the analysis made by VoxNews, where after researching the file with the laws or codes, it turned out that the justice men in Berat simply desecrated the laws of the Albanian state in the most banal way, some of which were approved in Parliament by 3/4 of the deputies.
Moreover, the suspension of the director of the AMP, Florian Sulejmani, was in open contradiction with the law itself on the functioning of SPAK or the Special Court, since the investigation and trial of the heads of central or independent institutions is their competence.
"The Berat Prosecutor's Office and Court have taken on the attributes of this accusation, openly challenging the Special Prosecutor's Office, since not only did they not delegate the accusation to this body, but they went ahead and requested a security measure from the court ," VoxNews quoted them a few days ago. In the press release, the Berat Prosecutor's Office "boasted" that it had also analyzed the law on "judicial police" or the law on "the functioning of the AMP". But it read it wrong!
In one of the articles of the AMP law, it is written literally; The Director General appoints, transfers, dismisses and expels the Agency's employees and administrative employees! Where is the violation with the transfer of employees?! Or more precisely, what criminal offense did the director commit when he implemented the AMP law?!
And most importantly, VoxNews asked: What connection does the Berat Prosecutor's Office have with the director of the AMP operating in Tirana?! Berat's accusation consisted of the fact that they had not even read Article 16 of the AMP law, where the responsibilities of the General Director were to "appoint, transfer, dismiss and exclude the Agency's employees and administrative employees."
It seems that the Berat massacre could have been orchestrated elsewhere, since the heads of institutions that operate by law are investigated only by the Special Prosecution Office. Article 75, section a) of the SPAK law, stipulates that; “ The competences of the Court against Corruption and Organized Crime are criminal charges against the President of the Republic, the Speaker of the Assembly, the Prime Minister, .... and the heads of central or independent institutions defined in the Constitution or in law”.
Could the Berat Prosecution and Court have been so foolish as to take over the powers of SPAK?! Now, if they have abused their duty, or may have been instigated by third parties, and have used the hammer and scales of justice in a personal manner, perhaps the time has come for SPAK itself to investigate them?!
