Documents revealing Luciano Boci, ALBTEK was seized since 15 December 2021

A few weeks ago, two opposition Edmond Spaho and Petrit Vasili tried to fish the public opinion with the claim that they had uncovered a super scandal. Deliberately misinterpreting the legal acts they stated that the concessionary company that built the incinerator of Elbasan had received from the Ministry of Energy a second concessionary contract that provided it with the rights to produce and trade energy from the waste burning for 25 years and not only 7 years as long as the concession was the lifespan of the concession. So bluntly, they meant that even when the state took over the incinerator in the 8th year, private would sell the energy and receipt the revenue. An idiot who was dismissed with obvious facts, facts that he has and the prosecution that is investigating the incenerator case, which Spaho and Vasili dared not speak about anymore.

It became clear that the Ministry of Energy and Industry has not issued a second concession to the incenerator company. In the application of the contract that the company had in force with the Ministry of Environment, the Ministry of Energy had the legal obligation to authorize and open the licensing route of the company "ALBTEK ENERGY" shpk. for the production and trade of energy. At the end of the concessionary contract, i.e. at the end of the 7-year period of the concession of the incenerator of Elbasan, this work is transferred to the administration of seven municipalities of the District of Elbasan. The latter take ownership of the work and automatically acquire the rights acquired by the company in relation to the asset.

But today, another awakened oppositionr from the lethargic sleep after the catastrophic loss in the race for the Municipality of Tirana appeared. Someone has wanted to mock Luciano Boci and worse that the latter has not followed even his colleagues in previous failed attempts at the issue. Boci stated that "ALBTEK turns out to have a profit for 2022 about 860 million ALL, although the owner is convicted of the incinerators affair and the company is in sequestration. ALBTEK owns the power generation plant within the incinerator for 25 years although the accused including Rama and today they declare without any accountability that the electricity production plant is owned by the Municipality of Elbasan.

So, the same Luciano who in May this year protested at the incinerator doors promising to tear it down because it had not worked a day since it was built, today he comes out and says that he not only worked from 2015 to 2021 when the concession period ended but also during 2022. First, which Luciano do we believe? What he says hasn't worked or what he says has worked!??

Second, as anyone interested can see, the concessionary contract clearly states that ALBTEK Energy is a company created only to manage the operations of the elbasan incenerator and no other activity. According to the contract, at the end of the concession period of 7 years, the company together with its physical assets and all its rights and obligations passes to the state and is managed by a new company which is created with shareholders all municipalities of Elbasan County.

Që nga 15 Dhjetori 2021, pra 16 ditë pa përfunduar kontrata koncesionare, inceneratori i Elbasanit, kompania ALBTEK Energy bashkë me të gjitha të drejtat e saj janë vënë nën sekuestro nga SPAK në kuadër të hetimeve që po bëheshin. Nëse koncesionari sipas kontratës humbte të drejtat mbi kompaninë dhe asetet e saja në 31 Dhjetor 2021, në realitet i humbi ato edhe 16 dite më herët.

Nga ai moment, administrator i ALBTEK, aseteve dhe të drejtave është shtetasi Arjan Baçi për llogari të Agjencisë së Administrimit të Aseteve të Sekuestruara dhe Konfiskuara. Pra flasim për fundin e vitit 2021. Është Baçi që ka çuar në QKB bilancet ekonomike të vitit 2022 për të cilat flet Luçiano Boçi. Në marrëveshje me administratorin shtetëror, 7 bashkitë e Qarkut të Elbasanit kanë krijuar shoqërinë e tyre ECO-ELB sh.a. përmes të cilës bëjnë operimin e inceneratorit dhe trajtimin e mbetjeve të Bashkive Elbasan, Librazhd, Prrenjas, Belsh, Gramsh, Cërrik e Peqin. Çdo e ardhur e deklaruar pas 31 Dhjetorit 2021 i përkeq shtetit dhe asnjë cent nuk shkon për subjektin privat që e operonte inceneratorin për 7 vitet e koncesionit.

Nastradin Boçi duhet të kuptojë se inceneratori ka për objekt incenerimin e mbetjeve dhe jo riciklimin e figurave të djegura politike. Për të mos u bërë qesharak dhe më tej, mirë do ishte që të mos përdorej nga ata që e gënjejnë sikur kanë zbuluar skandale. I vetmi skandal në këtë rast është një profesor që mashtron nga dashakeqësia apo nga injoranca juridike! Këtë dilemë duhet ta zgjidhë ai vet!
