Private investments in gas infrastructure. Rules needed to obtain approval

Any entity or association of companies can apply for an approval for the construction and use of the infrastructure of gas systems, while the Council of Ministers has approved the decision, which determines the procedures that interested investors must follow. The decision specifies the documents that must be submitted to the ministry responsible for hydrocarbons.

Initially, the entities that meet the criteria will be provided with a preliminary approval, while additional documents are then needed, starting from the urban study for the construction of the infrastructure of the gas systems, the approval for the transformative developments in the territory, in accordance with the legislation on cultural heritage; environmental permit, opinion of the Energy Regulatory Body, etc.

Meanwhile, the final approval for the development of the project is given by the Council of Ministers, which must approve the contract signed between the subject and the minister responsible for energy.

The decision recently approved by the government also determines the fees that entities must pay for obtaining approval for the construction and use of the infrastructure of gas systems. For projects with an investment value of up to 100 million ALL, the payment is 5 million ALL, for investments up to 300 million ALL, the fee is 10 million ALL, while for projects with an investment value over 300 million ALL, the fee will be 30 million ALL.

Meanwhile, as far as the application for permission from state entities is concerned, the government decision stipulates that it is done in the ministry responsible for energy, only after the preparation of the final construction project has been carried out in compliance with the provisions of the law on public procurement.
