Veliaj has a mandate and a pen, but can he use it?!

There has been a debate going on for days about a question that at first glance seems technical, but in fact touches on the very meaning of the rule of law. Can a mayor who is in detention continue to sign official documents and acts of the institution he leads?

It's hard to have a definitive answer to this question, but I'm trying to provide a rationale based on written laws and the cold logic that stems from these laws and judicial decisions.

It is undoubtedly paradoxical to conclude that the mayor under arrest has a mandate, but not so much a signature.

This is not a play on words. It is the distinction that the law itself makes between the status of an elected official and the exercise of his powers under the conditions when criminal laws on pre-trial detention operate.

A. Clearly, the mandate of a local elected official is not suspended by detention.

The Criminal Procedure Code has been very careful to protect the democratic legitimacy of elected officials.

Article 242, which regulates the security measure “suspension of the exercise of a public duty or service”, expressly excludes its application to persons elected under the electoral law. This means that SPAK and the court cannot suspend the mandate of a mayor through a security measure.

Precisely for this reason, as well as the Law on Local Government, Erion Veliaj remains, formally, Mayor of Tirana. His mandate has not been terminated or suspended. Until there is a legal reason for the termination of his mandate, he continues to be elected by the citizens.

There is no dilemma here. The Constitutional Court has clearly clarified this in its first decision when it stopped Velilaj's dismissal.

B. But, logically, imprisonment is not an alternative office.

The problem begins when there is an attempt to equate the existence of the mandate with the normal exercise of the function.

Article 238 of the Code of Criminal Procedure states that a person under arrest shall be placed in a detention facility and kept at the disposal of the prosecuting authority. He shall be deprived of freedom of movement and of the opportunity to exercise his normal activity.

A mayor is not a notary who signs papers wherever he is. He is an administrative body. His authority is exercised within the institution, based on administrative procedures, documentation, protocol, verifications and legal responsibilities.

Therefore, detention does not remove the mandate, but makes its normal exercise practically and legally impossible.

C. The signature is not a pen.

A concept is deliberately confused here.
Many say: "What's the problem? Let them take the documents to his cell and he will sign."

Problemi është se firma e një kryetari bashkie nuk është një akt privat. Nuk është një autorizim familjar, nuk është një kontratë civile dhe as një deklaratë personale. Të paraburgosurit firmosin rregullisht dokumente private.

Por aktet zyrtare nuk janë dokumente private.

Firma është elementi përfundimtar i një akti administrativ që prodhon pasoja juridike për qytetarët, bizneset dhe vetë administratën.

Përpara se të hidhet ajo firmë duhet të kenë ndodhur procedura të caktuara: shqyrtim, relacione, verifikime, protokollim, administrim i dosjes dhe përgjegjësi institucionale.

A mund të garantohet e gjithë kjo brenda një institucioni paraburgimi?

Llogjikisht jo.

Në të kundërt, do të pranonim idenë absurde se zyra e kryetarit të Bashkisë së Tiranës mund të transferohet përkohësisht në qelinë e paraburgimit në Durrës…

D. Ligji ka parashikuar zëvendësimin, jo qeverisjen nga qelia.

Ligji për vetëqeverisjen vendore nuk e lë bashkinë pa drejtim.

Kur kryetari ndodhet në pamundësi objektive për të ushtruar funksionin, kompetencat ushtrohen sipas mekanizmit të zëvendësimit nga nënkryetari ose funksionari që përcakton ligji.

Pra zgjidhja e ligjit nuk është që dokumentet të bëjnë udhëtimin Bashki–Paraburgim–Bashki.

Zgjidhja është vazhdimësia institucionale.

Në një shtet serioz funksionon institucioni, jo vendndodhja fizike e firmës.

E. Atëherë pse mbahet mandati?

Sepse Kushtetuta mbron votën e qytetarëve.

Një masë sigurimi nuk mund të zëvendësojë vendimin e zgjedhësve. Një person është i pafajshëm derisa të dënohet me vendim të formës së prerë.

Prandaj ligji nuk lejon që paraburgimi të shndërrohet në mekanizëm për rrëzimin e një mandati të fituar në zgjedhje.

Por po aq e vërtetë është edhe e kundërta se prezumimi i pafajësisë nuk e shndërron paraburgimin në një mënyrë të re të ushtrimit të pushtetit publik.

Janë dy parime që disi duhet bashkëjetojnë.

Rasti Veliaj ka prodhuar një paradoks që ndoshta nuk ishte menduar kurrë nga ligjvënësi.

Nga njëra anë, SPAK-u kërkon ta mbajë në paraburgim me argumentin se ekzistojnë rreziqe procedurale.

Nga ana tjetër, pranohet ideja që i njëjti person të vazhdojë të firmosë akte zyrtare, të japë urdhra administrativë dhe të drejtojë institucionin.

Kjo krijon një kontradiktë të dukshme.

Nëse paraburgimi është aq i domosdoshëm sa ta izolojë një person nga jeta publike për të garantuar procesin penal, si mund të thuhet se ai ushtron pa asnjë pengesë funksionin më të rëndësishëm administrativ të bashkisë më të madhe të vendit?

Ose njëra tezë bie, ose tjetra.

F. Nuk është çështje politike, por juridike

Ky debat nuk ka lidhje me emrin Erion Veliaj.

Sot është Veliaj. Nesër mund të jetë çdo kryetar bashkie, deputet apo i zgjedhur tjetër.

Prandaj përgjigjja duhet të jetë e njëjtë për të gjithë.

Një i zgjedhur vendor mund ta ruajë mandatin edhe kur është në paraburgim. Kjo është garancia kushtetuese e votës.

Por ai/ajo nuk mund ta ushtrojë funksionin në paraburgim. Sepse kompetenca publike nuk ushtrohet me korrespondencë nga qelia.

Veliaj may be worth the mandate, but not so much the signature.

Because the citizens gave him the mandate. While only the law allows him to sign, and the law does not recognize the administration of the Municipality from detention.

In conclusion, a logical vacuum has clearly been created in the implementation of local elected laws with criminal laws. The courts have not been able to close this logical vacuum. It is perhaps up to Parliament to clarify it.
