The government has approved radical changes to the regulation for beach resorts, giving new powers to municipalities to control the prices of sun loungers and creating a new category of public beaches.

Today's decision by the Council of Ministers, which amends the 2024 regulation, brings stricter rules for the upcoming summer season, including rivers on the tourism map, in addition to the sea and lakes.

Ceiling prices for sun loungers

For the first time, Municipal Councils will have the right to set “ceiling prices” before the start of the season. The decision stipulates that “the municipality may approve maximum prices for each coastal area, which will serve as a limit for private entities.”

If the Municipal Council does not make a decision, the maximum price will be negotiated between the municipality and the private party at the time of signing the contract.

"The agreed maximum prices become a binding part of the contract and cannot be exceeded throughout the season. Exceeding them constitutes a breach and grounds for termination of the contract," the decision states.

New category, public beach with payment from the Municipality

The decision creates a new concept: “Public beach charged by the Municipalities”. These are beach areas that will be administered directly by the Municipality (or its enterprises) and will be subject to a fee for vacationers, but with guaranteed safety and hygiene conditions.

The novelty is that these beaches are prohibited from being given to private individuals. That is, the municipality cannot contract or delegate them to third parties, thus avoiding abuses of public spaces.

Rules for strategic investors and noise

Another important point concerns “Strategic Investors.” They will have priority for a beach resort, but with a non-negotiable condition: the right to use the beach begins only after the accommodation structure (hotel/resort) is put into operation.

This measure aims to curb the encroachment of beaches by construction sites or unfinished projects. Municipalities are also required to publish noise maps for each beach before the start of the season.

Exemptions for non-hotel businesses

The decision lists several specific areas where entities can have a beach station (maximum 50 umbrellas) even if they do not have a hotel, but only a restaurant/bar. This applies to beaches such as: Zvërnec, Plazhi i Vjetër (Vlorë), Spille, Vilë-Bashtovë, Gjiri i Lalzit, Currila, Porto-Romano (Durrës), Borsh, Llaman, Lukovë (Himarë) and Rrjoll (Shkodër).

The decision enters into force immediately and tasks the Ministry of Tourism and the National Coastal Agency with monitoring its implementation.
